No Partnership, Joint Venture or Agency. The Borrower agrees that nothing contained in this Financing Commitment nor the conduct of any party shall in any manner whatsoever constitute or be intended to constitute any party as the agent or representative or fiduciary of the other, constitute or be intended to constitute a partnership or joint venture between CIBC and the Borrower.
