In particular, the Union recognizes that the Company, under the Americans with Disabilities Act (ADA) as amended, the NJ Law Against Discrimination (NJLAD), and other applicable state or local laws, must make reasonable accommodations for qualified individuals with disabilities, unless this causes undue hardship to the Company. In addition, there will be no discrimination against any Supervisor for past, current, or future military obligations. In particular, the Union recognizes the Company’s obligations under the Uniformed Services Employment and Reemployment Rights Act (USERRA). As such Supervisors called to active duty will continue to accrue seniority and other covered benefits, as mandated by the Act. In order to comply with the provisions if these Acts, the Union recognizes that the Company may take actions or make decisions, either whole or in part, which are inconsistent with the provisions of this Agreement.

  • Harassment & Discrimination The local parties will determine the appropriate means of promoting an effective and meaningful way of addressing discrimination and harassment issues, which may include, but is not limited to the following: • Reviewing the hospital’s harassment policy and making joint recommendations to the Chief Nursing Officer; • Promoting a harassment free workplace where there is ‘zero tolerance’; • Ensuring that all employees are familiar with the employer’s harassment policy by identifying educational opportunities, including the orientation period for new employees; • Identifying supports and solutions to assist employees to deal with harassment and discrimination issues (i.e. Employee assistance Programs, staff supports); • Development of processes to address the accommodations/ modified work needs for nurses; • Development of assertiveness training programs.
