Common use of No Mortgagee in Possession Clause in Contracts

No Mortgagee in Possession. Neither the enforcement of any of the remedies under this Article IV, the assignment of the Rents and Leases under Article V, the security interests under Article VI, nor any other remedies afforded to the Mortgagee under the Loan Documents, at law or in equity shall cause the Mortgagee or any other Secured Party to be deemed or construed to be a mortgagee in possession of the Mortgaged Property, to obligate the Mortgagee or any other Secured Party to lease the Mortgaged Property or attempt to do so, or to take any action, incur any expense, or perform or discharge any obligation, duty or liability whatsoever under any of the Leases or otherwise.

No Mortgagee in Possession. Neither the enforcement of any of the remedies under this Article IVV, the assignment of the Rents and Leases under Article VVI, the security interests under Article VIVII, nor any other remedies afforded to the Mortgagee under the any applicable Loan DocumentsDocument, at law or in equity shall cause the Mortgagee or any other Secured Party to be deemed or construed to be a mortgagee in possession of the Mortgaged Property, to obligate the Mortgagee or any other Secured Party to lease the Mortgaged Property or attempt to do so, or to take any action, incur any expense, or perform or discharge any obligation, duty or liability whatsoever under any of the Leases or otherwise.

Neither the enforcement of any of the remedies under this Article IV, the assignment of the Rents and Leases under Article VV herein, the security interests under Article VIVI herein, nor any other remedies afforded to the Mortgagee under the Loan Financing Documents, at law or in equity Exhibit E to Credit Agreement shall cause the Mortgagee or any other Secured Party to be deemed or construed to be a mortgagee in possession of the Mortgaged Property, to obligate the Mortgagee or any other Secured Party to lease the Mortgaged Property or attempt to do so, so or to take any action, incur any expense, or perform or discharge any obligation, duty or liability whatsoever under any of the Leases or otherwiseotherwise prior to taking possession directly or through an agent.

Neither To the fullest extent permitted by applicable law, neither the enforcement of any of the remedies under this Article IVV, the assignment of the Rents and Leases under Article VVI, the security interests under Article VIVII, nor any other remedies afforded to the Mortgagee Beneficiary under the any applicable Loan DocumentsDocument, at law or in equity shall cause the Mortgagee Beneficiary or any other Secured Party to be deemed or construed to be a mortgagee in possession of the Mortgaged Property, to obligate the Mortgagee Beneficiary or any other Secured Party to lease the Mortgaged Property or attempt to do so, or to take any action, incur any expense, or perform or discharge any obligation, duty or liability whatsoever under any of the Leases or otherwise.
