No monitoring. Without affecting the obligations of the Borrowers in any way, no Finance Party is bound to monitor or verify the application of the proceeds of any Advance.

If iTools becomes aware that any Community Member Content or use of the ecPortal is or is likely, in the sole opinion of iTools, to (i) violate applicable laws or regulations (ii) infringe the proprietary rights of any third party or (iii) obscene or offensive, then, in addition to any other rights or remedies that iTools may have, iTools may, at its option, (i) remove the objectionable Community Member Content from the ecPortal or (ii) terminate the Community Members rights to continue use of the ecPortal. Community Members are solely responsible for their Community Member Content and to verify the validity and accuracy of the Transactions into which they enter with other Community Members.
No monitoring. You acknowledge and agree that the Web Environment shall function solely as a conduit for the receipt, storage, processing and transmission of Your End User Data. Pageflex shall not monitor, exercise control over, or provide any substantive review, evaluation, or assessment of any End User Data. You agree that, between You and Pageflex, You shall have complete responsibility for any claim by any person or entity that any End User Data supplied by You was unlawfully or improperly delivered, received, stored, processed, copied, adapted, reproduced, published, transmitted or divulged, and any other similar claims arising out of Your or another party’s proper or improper use of the Services or Software or accessing of the Web Environment.
