No Defects. Contractor's commencement of the Work constitutes Contractor's acceptance of the work of other contractors previously completed or commenced, and Contractor's acknowledgment that the Plans and Specifications are free of defects that would adversely affect Contractor's performance of the Work. Contractor waives all claims against Owner with respect thereto. If Contractor discovers a defect in the Plans and Specifications, the Work or in the work of others, Contractor shall immediately notify Owner of such defect.
No Defects. Each Financed Vehicle was properly delivered to the Obligor in good repair, without defects and in satisfactory order. Each Financed Vehicle was accepted by the Obligor after reasonable opportunity to inspect and test such Financed Vehicle and no Obligor has informed the Seller of any defect therein.
No Defects. DiaSys hereby warrants that at the time of Delivery, Workstations and Spares purchased hereunder shall be free from defects in materials and workmanship and shall conform to the specifications published by DiaSys ("Workstation Warranty") for a period of One (1) year commencing at date of Delivery ("Workstation Warranty period"). DiaSys also warrants that at time of Delivery, all Consumables purchased hereunder shall be free from defects in materials and workmanship and shall conform to the specifications published by DiaSys. 4.2

No structural, drainage or other material defects have appeared in respect of or affected the buildings and structures on or comprising the Premises or any parts thereof and all such buildings are in good and substantial repair and condition and none has been constructed, maintained, altered or repaired using materials containing any deleterious building material and none of the Premises has been affected by flooding or subsidence.
No Defects. If the Buyer has given such notice as mentioned in Clauses 6.4 and no defect is found for which SANOVO is liable, SANOVO shall be entitled to compensation for the costs he incurs as a result of the notice.

No Cybin Entity has received any notice or communication from any customer or any applicable regulatory authority alleging a defect or claim in respect of any products supplied or sold by a Cybin Entity to a customer except in the Ordinary Course of its Business and, to the Company's knowledge, there are no circumstances that would give rise to any reports, recalls, public disclosure, announcements or customer communications required to be made by a Cybin Entity in respect of any products supplied or sold by a Cybin Entity.
No Defects. To the best of Borrower’s knowledge, there are no defects in the design or construction of the Building which would have a material adverse affect on its value, safety or intended use.
No Defects. Ablecom warrants that the Products will operate in all material respects in accordance with the Specifications and will be free of defects in design for a period of six (6) months after the acceptance of the designs by Supermicro. If Supermicro should determine at any time within the warranty period that these materials do not operate in accordance with the Specifications, Supermicro shall notify Ablecom of the problem in writing, and Ablecom will promptly take at its expense all reasonable steps to correct the problem.
No Defects. The Target Equity is free from any Encumbrances; and there is no pending, or, to the knowledge of the Transferors, threatened or potential disputes, claims, lawsuits, arbitrations, enforcement, administrative proceedings or other legal proceedings relating to the Target Equity in any aspect.

To the knowledge of the Company, the software included in the Company Products is free from material defects and bugs, and substantially conforms to the applicable specifications and documentation. The Company has used commercially reasonable efforts to ensure that the software included in the Company Products does not contain, and to the knowledge of the Company, such software does not and shall not contain, (a) any clock, timer, counter, or other limiting or disabling code, design, routine, or any viruses, Trojan horses, or other disabling or disruptive codes or commands that would cause such software to be erased, made inoperable, or otherwise rendered incapable of performing in accordance with its performance specifications and descriptions or otherwise limit or restrict the Company’s or any person’s ability to use such software or the Company Products, including after a specific or random number of years or copies, other than in each case any disabling or disruptive codes or commands which were purposefully placed there by the Company to control the use by customers of the Company Products beyond use limitations communicated to customers, or (b) any back doors or other undocumented access mechanism allowing unauthorized access to, and viewing, manipulation, modification, or other changes to, such software.
