Common use of No Commissions Clause in Contracts

No Commissions. Neither the Operating Partnership, the Company nor any of their subsidiaries is a party to any contract, agreement or understanding with any person (other than this Agreement) that would give rise to a valid claim against the Operating Partnership, the Company or any of its subsidiaries or any Underwriter for a brokerage commission, finder’s fee or like payment in connection with the offering and sale of the Notes.

Neither None of the Company, the Operating Partnership, the Company nor Partnership or any of their respective subsidiaries is a party to any contract, agreement or understanding with any person (other than as contemplated by this AgreementAgreement or the Alternative Sales Agreements) that would give rise to a valid claim against the Operating PartnershipCompany, the Company Operating Partnership or any of its their respective subsidiaries or any Underwriter the Agent for a brokerage commission, finder’s fee or like payment in connection with the offering and sale of the NotesShares.
