NO ASBESTOS. A. Contractor shall execute and submit an “Asbestos Free Materials Certification." Contractor, further, is aware of the following:
NO ASBESTOS. All materials, supplies, and goods used or provided on this order, are to be “FREE OF ASBESTOS.” No product containing asbestos in any form may be provided, supplied, included, incorporated, encapsulated or sold to University.
NO ASBESTOS. Tenant agrees that no asbestos containing materials will be installed within the Leased Premises or exposed or disturbed in the Leased Premises through demolition, renovation or otherwise, at any time during or prior to Tenant’s possession and/or occupancy thereof unless such exposure or disturbance is required in the course of remodeling or restructuring the Leased Premises and is conducted in accordance with all applicable Laws;
NO ASBESTOS. Design-Builder shall execute and submit a Certificate Regarding Non-asbestos Containing Materials. Should asbestos containing materials be installed by Design-Builder in violation of this certification, or if removal of asbestos containing materials is part of the Project, decontaminations and removals will be performed in accordance with the requirements of all applicable laws and will meet the following criteria: Decontamination and removal of work found to contain asbestos or work installed with asbestos containing equipment shall be done only under the supervision of a qualified consultant, knowledgeable in the field of asbestos abatement, and accredited by the Environmental Protection Agency (“EPA”). The asbestos removal Design-Builder shall be an EPA accredited Design-Builder qualified in the removal of asbestos and shall be chosen and approved by the asbestos consultant who shall have sole discretion and final determination in this matter. The asbestos consultant shall be chosen and approved by the Owner which shall have sole discretion and final determination in this matter. The work will not be accepted until asbestos contamination is reduced to levels deemed acceptable by the asbestos consultant. If removal of asbestos containing materials is part of the Project, the costs of all asbestos removal, including but not necessarily limited to, the cost of the asbestos removal sustained by Design-Builder, the costs of the asbestos consultant, analytical and laboratory fees, time delays, and additional costs that may be incurred by the Owner shall be borne entirely by Design-Builder. HOLD HARMLESS/INDEMNITY
NO ASBESTOS. Not to install or permit to be installed on or in ----------- Borrower's Assets any friable asbestos or other asbestos substance prohibited by any Environmental Laws. If Borrower discovers asbestos on or in Borrower's Assets, Borrower shall at Borrower's expense comply with all requirements of the Environmental Laws regarding asbestos.
NO ASBESTOS. None of the products manufactured, distributed or sold by the Borrower or any of its Subsidiaries contain asbestos containing material.
NO ASBESTOS. All materials incorporated in the Demised Premises by the Approved Contractor shall be 100 percent free of asbestos-containing materials.
NO ASBESTOS. There is no asbestos present in any real property presently owned, leased or operated by LabMentors, and no asbestos has been removed from any real property while the real property was owned, leased or operated by LabMentors, except according to the requirements of the Clean Air Act and the Occupational Safety and Health Act and as disclosed on Schedule 3.14. 3.14.5
NO ASBESTOS. To Seller’s Knowledge, no asbestos, polychlorinated biphenyls or urea formaldehyde is or has been present at the Property or the Land in amounts that violate any Laws, nor have any of the foregoing been removed by Seller from the Property or the Land in violation of any Laws.
NO ASBESTOS. Except as set forth in Section 5.6 of the Sellers Disclosure Letter, the wire and cable products manufactured for sale or sold by the Business in the United States prior to the date hereof did not contain asbestos.
