Night Stocking. Where two (2) or more employees are working on a night shift in a store where regular or systematic night stocking is in effect and there is not a premium rate clerk, assistant manager or management personnel in charge, the person in charge shall not be compensated at less than the Lead Hand rate which shall be one dollar ($1.00) per hour over the employee's regular rate. Night Stocking. The Employer agrees to schedule a night stocking crew consecutive days of work wherever possible, subject to the operational needs of the store. Where it can be demonstrated that the scheduling of consecutive days of work cannot be scheduled, the Union and the Employer shall meet and determine a method of solution.  No clerk shall be required to work alone on the premises for night stocking.  Night stocking is a scheduled shift commencing at 9:00 p.m. and concluding at 5:30 a.m.  An employee scheduled for night stocking will receive one dollar ($1.00) per hour worked in addition to their regular hourly rate of pay.  The Lead Hand will receive both the Lead Hand rate of fifty cents ($0.50) per hour and the additional one dollar ($1.00) per hour night stocking premium in addition to their regular hourly rate of pay.

Night Stocking. In the event that night stocking becomes necessary, the Parties shall meet to discuss its implementation. If night stocking is implemented, one (1) employee on the night stocking shift shall be designated as Lead Hand and shall be paid a premium of one dollar ($1.00) per hour in addition to their regular rate of pay. This clause shall not apply to short-term initiatives lasting no more than two (2) weeks at a time. If the parties cannot agree on terms of implementation, the matter shall be referred to Arbitration. The principles to be decided by the Arbitrator are fair rotation, flexible start times, and consistent start times.
Night Stocking. The Employer will to the extent practicable and where it will not interfere with the efficient operation of the business, allow a full-time employee who requests to opt out of night stocking work and move to the day shift (defined for the purpose of this section as generally hours during which the store is open for business) after a minimum of three (3) months on nights. Said employee will be allowed a minimum of three (3) months on days before being re-assigned to nights.

An employee working as a night Xxxxxxx shall be paid ten cents (10£) per hour in addition to his regular hourly rate for such work perform­ ed between 6:00 P.M. and 7:00 A.M., provided such employee works beyond the normal store closing hour. If such employee does not work beyond the normal store closing hour, the night premium of ten cents (10£) per hour shall not be paid.
