Common use of Night rate Clause in Contracts

Night rate. An employee whose normal hours of duty fall between 2000 hours and 0600 hours will be paid at time one quarter of the normal hourly rate of pay (T0.25) in addition to normal salary for all hours which so fall provided that:

(a) An employee whose normal hours of duty fall between 2000 hours 8pm and 0600 hours 6am will be paid at time one quarter of the normal hourly ¼ rate of pay (T0.25) in addition to normal salary for all hours which so fall fall, provided that:that the minimum payment under this provision shall not be less than payment for two hours at time ¼ rate even if the part of a shift which falls between the hours of 8pm and 6am is less than two hours; Night rate is not to be paid for the same hours as either overtime or penal rates.
