New Stores. JJC agrees to inform Distributor in writing at least thirty (30) days in advance of each new Store opening within the Distribution Territory. New Stores will place their opening Orders with Distributor at least ten (10) days prior to the requested delivery date and Distributor will confirm the opening Order delivery date three (3) days prior to the delivery. Any change by the Store to the opening Order delivery date once the Order has been placed with Distributor must be made at least two (2) days prior to the opening Order delivery date or the Store shall be subject to a one-time special handling charge of .
New Stores. The Union agrees that, in the event that Stong's wishes to purchase a new or existing store with or without an existing Collective Agreement, a lesser agreement than the "Stong's Agreement" may be entered into.
New Stores. The Company shall deliver written notice to the Agent at least five business days (or such shorter period as the Agent may agree) prior to the Company or any of its Subsidiaries (i) opening or operating any new fine jewelry department or (ii) opening of any new factory outlet store provided however, that the Company shall provide the Agent with a list of projected fine jewelry department and outlet store openings on a biweekly basis.
New Stores. The Employer and the Union agree that the following terms and conditions of employment shall apply to all New Stores (including acquisitions) that open after ratification, 2010.
New Stores. In the Borrower's fiscal year ending March 28, 1999, the Borrower shall not permit the number of new stores opened by the Borrower minus the number of stores closed by the Borrower to exceed 65.
New Stores. Fifty percent (50%) of the non-Key Personnel full-time positions in a new store shall be posted and made available to employees in the bargaining unit. The Employer will evaluate capability, merit and ability in a just manner and award the position.
New Stores. Subject to Sections 4.3 and 6.13, hereof, if any Stripes Entity commences or acquires operations of any Store during the term of this agreement that is not subject to a then-existing service agreement with McLane or a then-existing service agreement with another wholesale supplier that is not capable of being terminated for convenience, that Store will be, upon such commencement of its operation or management by a Stripes Entity (or upon the expiration or termination of such other agreement with another supplier, if applicable), included within the definition of Stores and subject to the terms and conditions of this agreement.
New Stores. Sales Representatives will stock the product as set out in the present Collective Agreement.
New Stores. Seller shall provide Buyer all relevant information as to leases which have been entered into prior to the date hereof and which relate to stores not yet opened in the Los Angeles Metropolitan Area (the "New Leases") (it being understood that Seller shall not enter into any such leases after the date hereof). Buyer shall have the right, by written notice to Seller delivered at any time before the Closing Date, to cause Seller to assign to the Company any or all such New Leases at no additional cost to Buyer, except that Buyer shall be responsible for the performance of said leases subsequent to the Closing as provided in Section 5.04. Seller agrees with respect to any such store under development that such store will be developed in accordance with a format, and with decor, provided by Buyer and that Seller shall not install fixtures or inventory in such store prior to the Closing.
New Stores. If SFM opens new locations, KeHE shall become the Primary Supplier of the Products, as defined above, for such stores and SFM and KeHE shall work in good faith to ensure that [*CONFIDENTIAL*] and as reasonably acceptable to SFM.
