Network Availability. The Vyve network shall be available for use by Customer with the Fiber Service provided under the Agreement at least 99.99% of the time as measured over the then current monthly period (“Network Availability”). Network Availabilityshall be calculated by dividing the number of minutes that the Services are available for Customer’s use by the total number of minutes of such calendar month and multiplying the result by 100. In calculating Network Availability, Service Interruptions (as defined below) resulting from the reasons or causes set forth in Section 3.4 of these Additional Terms and Conditions shall not be included in determining whether Vyve has met the applicable performance standard for Network Availability. For example, if the Fiber Service experiences an outage for one (1) day due to a Force Majeure Event, and otherwise experience no other outage or Service Interruption (as defined in Section 5.2) during the applicable month, Vyve will be deemed to have met the Network Availability performance standard of 99.99%.

Network Availability. 3.1 The minimum performance level for network availability shall be 99.9% over any time period, with a minimum of 3 months.
Network Availability. Network availability is defined as Company network’s ability to pass incoming and outgoing TCP/IP traffic. Servers unavailability caused by network unavailability is not included in server uptime if such network unavailability is caused by factors beyond the Company’s control. Interruptions of service due to problems on the backbone or on the customer’s desktop or network are beyond the Company’s control. Interruptions of service caused by denial of service or similar attacks are beyond the Company’s control and are not included in downtime calculations.

Network Availability does not mean Customer will be able to reach any site or user on the Internet, nor does it mean any site or user on the Internet can reach Customer, as there are many factors, outside of CenturyLink’s control, that can affect an end-to-end connection. Network Availability eLMS will be available to the City of Calabasas through the internet using a unique URL. The City of Burbank’s goal is to make the application available to the City of Calabasas free of network outages 99.9% of the time except during scheduled downtime or emergency maintenance periods. To match the City of Burbank provided 3 Mbps and to achieve optimal performance, the City of Calabasas should have equal network connection speed dedicated to the eLMS application.
Network Availability. The Supplier guarantees 99.999% uptime of the network within its data centres during any calendar month, measured at its backbone routers and switches and 99.999% connectivity to upstream carriers where bandwidth is provided as part of the Services. For the purposes of measuring performance against this SLA, standard BGP re- negotiation periods are excluded. The Supplier cannot guarantee routing, latency or packet loss once data traffic has left its own network however the Supplier, so far as is practicable, will configure its routers and switches to ensure outbound data traffic is routed via the available carriers with the best routes to the destination addresses.
