Negotiations Release Time. Subject to patient care requirements, the Employer will make a good faith effort to assist in providing unpaid release time for employees participating in contract negotiations. Employees will work with their managers to arrange this time off. Unpaid release time to participate in this activity will accrue benefits.

Generally no more than four (4) on-duty personnel may attend such negotiating sessions. No compensation shall be provided by the Employer for negotiation activities outside the employee’s work shift and off-duty personnel attending negotiating sessions shall not receive any compensation for such attendance.

The Employer shall endeavor to allow a minimum of three (3) members of the Guild’s negotiation committee to attend negotiation sessions during on-duty time, provided however, that operational necessities shall remain the priority and not more than two of the on-duty members shall be from any single division or workgroup, without prior authorization of the Chief or designee. Such members shall be designated by the Guild at least one (1) week in advance, where possible, and may include individuals assigned to other than day shift if the Employer determines that staffing on that shift is adequate, without the necessity of overtime (such individuals shall be considered to be transferred to day shift for the day on which the negotiation session is held).
Negotiations Release Time. The Employer agrees that it will provide paid release time for up to six (6) Union negotiating team members participating in contract negotiations providing that: (1) at least five (5) days of advance notice is provided by the Union of the identity of the employees who will be attending the negotiations; (2) time spent on contract negotiations at the table or in caucus shall not be construed as “time worked” for purposes for determining overtime; and (3) the aggregate amount of paid negotiations time shall not exceed 192 hours. The number of hours can be extended by mutual agreement. The Employer shall grant the requested time off unless, in its discretion, it determine that to do so would create staffing problems.

In no case shall more than four (4) on- duty personnel attend such negotiating sessions. It is mutually understood that the Employer may cancel and reschedule bargaining sessions if staffing needs cannot be reasonably met. Off-duty personnel attending negotiating sessions shall not receive any compensation for such attendance, however with notice and within reasonable bounds, the Employer will work with the employee in an attempt to “flex” the work schedule of off-duty personnel and/or set negotiation sessions at varying times of the day. On-duty bargaining unit personnel may participate in hearings (e.g. contract arbitration or PERC at state or local level) as witnesses without loss of pay or leave for the duration of their testimony, including reasonable travel time to and from the hearing. All other bargaining unit personnel shall attend without pay. However, one bargaining unit member attending Civil Service hearings, PERC hearings, and contract arbitration during regularly scheduled duty hours may do so without loss of pay.

If the Court is unable to provide release time under these requirements, the Court agrees that negotiations may be scheduled outside regular work hours. Generally, no more than one (1) on-duty personnel may attend negotiation sessions. No compensation will be provided by the Employer for negotiation activities outside the employee’s workday. Off-duty personnel attending negotiating sessions will not receive any compensation for attendance. The negotiating teams will consist of a comparable number of representatives.
