Negotiating Agent. The Board of Education agrees not to negotiate with any other teachers' organization, individual teacher, or group of teachers with regard to negotiable items as defined in Article I, Section 1.3, unless otherwise provided for in this Agreement or unless mutually agreed to by the parties during the term of this Agreement. Nothing herein, however, shall in any way prevent or otherwise impair the right of any teacher from discussing or otherwise communicating with the Board of Education or Administration on any matter, including those set forth in Article I, Section 1.3.

Negotiating Agent. ARTICLE I
Negotiating Agent. The Board recognizes the Kenton County Education Association as an official negotiating agent for regularly employed certificated personnel and those holding a statement of eligibility for provisional certification in the following bargaining unit: All regularly employed certificated personnel in the Kenton County School District, Kenton County, Kentucky except for: Superintendent; Chief Academic Officer Chief Operating Officer Assistant Superintendents; Executive Directors; Directors; Assistant Directors; School Psychologists; Counselors; Principals; Assistant Principals; Coordinators; Consultants; Non-certificated employees; *Part-time employees; Employees holding positions for which certification is not required. *Part-time employees are covered in all areas of the contract unless prohibited by KRS.

  • Negotiating Teams The Board, or designated representatives appointed to serve on its team, will meet with representatives designated by the Association for the purpose of establishing procedures for negotiating and reaching mutually satisfactory agreements. Each party's negotiating team shall consist of not more than five members.

  • Negotiating Committee The Hospital agrees to recognize a Negotiating Committee comprised of representatives of the Association for the purpose of negotiating a renewal agreement. The number of nurses on the Negotiating Committee is set out in the Appendix of Local Provisions. The Hospital agrees to pay members of the Negotiating Committee for time spent during regular working hours in negotiations with the Hospital for a renewal agreement up to, but not including, arbitration.

  • Negotiating Team ‌ The Association shall be allowed the following maximum number of paid employees from each facility as a member of the Negotiating Team with the Agency assuming no overtime obligations as a result of employees’ attendance at such meetings:  SACU: one (1) per house and one (1) Outreach Nurse  Xxxxxxxxx Cottage: one (1) At the discretion of the Association, a reasonable number of unpaid employees may attend negotiation sessions as observers. Consultants may be employed by either party.

  • Negotiators 1. Each party may be represented at all negotiations by a maximum of seven (7) negotiators of the parties’ choice. Either party may also have an observer in attendance.

  • NEGOTIATING PROCEDURE The Board agrees to make available to the Association when available to the Board information concerning the financial resources of the District, including but not limited to: annual financial reports and audits; register of Certificated personnel; tentative budgetary requirements and allocations; agendas and minutes of Board meetings; census data; names and addresses of all certificated employees; and public information available to the Board that will assist the Association in developing intelligent, accurate, informed, and constructive programs on behalf of certificated employees and their students. The District and the Association agree to meet prior to the setting of the district budget for the ensuing year in order to provide the Association with an opportunity to provide input on budgeting priorities.

  • Local Negotiating Committee (a) A negotiating committee of four (4) employee representatives appointed by the union including the bargaining unit president.

  • Mediator This mediation will be conducted by Xxxxx Xxxxxxxx.

  • Union Negotiating Committee (a) The Employer shall recognize a Union Negotiating Committee that may include, as determined by the Union:

  • Agent Subject to any other written instructions of the Adviser or the Trust, the Subadviser is hereby appointed the Adviser’s and the Trust’s agent and attorney-in-fact for the limited purposes of executing account documentation, agreements, contracts and other documents as the Subadviser shall be requested by brokers, dealers, counterparties and other persons in connection with its management of the Subadviser Assets. The Subadviser agrees to provide the Adviser and the Trust with copies of any such agreements executed on behalf of the Adviser or the Trust.

  • Sellers’ Representative (a) Each of the Sellers hereby appoints Xxxx Xxxxx as Seller’s Representative hereunder for the purposes of representing his or its individual interests. Each of the Sellers hereby authorizes the Sellers’ Representative to act on his or its behalf with respect to all matters arising under this Agreement requiring or contemplating the possibility of some notice to be sent to or from, or some action to be taken by, the Sellers, including acting as the Sellers’ representative for the purpose of settling on behalf of the Sellers any claims made by Buyer under Section 12.1(a)(i), representing the Sellers in any indemnification proceedings under Section 12.3, approving any waivers or amendments in accordance with Section 13.6, but excluding the settling of any claims made by Buyer under Section 12.1(a)(ii) against a Seller. Except as aforesaid, each Seller hereby agrees to be bound by any and all notices sent and actions taken (and notices not sent and actions not taken) by the Sellers’ Representative on his or its behalf pursuant to this Agreement. If for any reason the Sellers’ Representative shall be unable to perform its duties hereunder as Sellers’ Representative, the holders of a majority in interest of the Interests owned immediately prior to the Initial Closing shall appoint a replacement Sellers’ Representative. Buyer shall be entitled to rely exclusively upon any communications or writings given or executed by the Sellers’ Representative and shall not be liable in any manner whatsoever for any action taken or not taken in reliance upon the actions taken or not taken or communications or writings given or executed by the Sellers’ Representative. Buyer shall be entitled to disregard any notices or communications given or made by any Seller, in his or its individual capacity, which is contrary to a notice or communication given or made by the Sellers’ Representative.
