Nature of Commitment. Both parties agree and affirm that the Donor shall receive no goods or services for this contribution, other than the acknowledgment and recognition described herein. This contribution shall have no connection to any business relationship established at any time between the Donor and the City.
Nature of Commitment. Lender’s obligation to accept the Note or make any Advances thereunder shall be deemed to be pursuant to a contract to make a loan or to extend debt financing or financial accommodations to or for the benefit of Borrower within the meaning of Sections 365(c(2) and 365(e)(2)(B) of the United States Bankruptcy Code, 11 U.S.C. § 101 et seq.
Nature of Commitment. 5.1 Any commitment in terms of Part 1 (List of Committed Obligations) to this Schedule 6.1 shall be in addition to any obligation of the Franchisee elsewhere in this Agreement and nothing in this Schedule 6.1 shall limit or restrict an obligation imposed on the Franchisee elsewhere in this Agreement.
Nature of Commitment. Executive Director understands that the duties and responsibilities of Executive Director are a significant commitment (full-time or part-time, as specified in the Basic Terms), and acknowledges that he/she is expected to work the required number of hours per week specified in the Basic Terms, which shall be performed at the office of the Authority during its established business hours (unless the job duty or business function requires the Executive Director to travel to a location other than the LHA’s main office.) Executive Director agrees that he/she shall not engage in any business or other activity which would interfere with or conflict with his/her duties as Executive Director, in accordance with the Massachusetts Conflict of Interest law. This paragraph shall not prevent Executive Director from undertaking speaking engagements or other professional activities, provided that such activities do not interfere with or conflict with his/her duties as Executive Director. Executive Director shall obtain, in advance, the approval of the Board before engaging in such activities.

With respect to the Loan and the Advances, Lenders' obligation to make the Loan or any Advances shall be deemed to be pursuant to a contract to make a loan or to extend debt financing or financial accommodations to or for the benefit of Borrower within the meaning of Sections 365(c)(2) and 365(e)(2)(B) of the United States Bankruptcy Code, 11 U.S.C. Section 101 et seq.
Nature of Commitment. With respect to each disbursement or advance hereunder, the Lender’s obligations to make such disbursement or advance shall be deemed to be pursuant to a contract to make a loan or extend debt financing or financial accommodations to Borrower within the meaning of Sections 365(c)(2) and 365(e)(2)(B) of the Bankruptcy Code of the United States of America, 11 U.S.C. § 101 et seq., or any subsequent bankruptcy legislation in effect during the term of this Agreement.
Nature of Commitment. In-House shall make qualified therapists and non-therapist personnel available to Owner on an as-needed basis to provide those services listed on Schedule A attached hereto (the "Services") to Owner's patients at the Treatment Facility. 3. Specific Commitments of In-House (a) Services from Therapists In-House shall provide Services as ordered by physicians to the Owner's patients who request that Services be provided by In-House, through qualified therapists under the terms and conditions of this Agreement and in accordance with any and all applicable requirements of federal and state laws, rules and regulations. (b) Training and Patient Care Conferences The therapists provided by In-House under this Agreement for the rendering of services in the Treatment Facility shall comply with the Owner's patient care policies, shall participate in individual patient care planning meetings for patients receiving therapy at the Treatment Facility and shall participate in staff meetings and conferences for the purpose of discussing policies and plans of treatment and general issues related to therapy patient treatment matters. Therapists provided by In-House will also participate in the Treatment Facility's in-service educational training programs as reasonably requested. (c)

Nature of Commitment. The Banks’ obligation to make any Advance shall be deemed to be a transaction made pursuant to a contract to make a loan or extend debt financing or financial accommodations to Borrowers within the meaning of Sections 365(c)(2) and 365(e)(2)(B) of the Bankruptcy Code of the United States.
Nature of Commitment. Each Lender's individual commitment is separate and distinct from the individual commitments of the other Lenders. The amount of each Lender's commitment will be stated opposite its signature at the end of this Agreement or in the supplement making such Lender a party to this Agreement. No Lender will be liable for the failure of another party to this Agreement to perform such other party's obligations under this Agreement.
