Name of Adviser. The parties agree that the Adviser has a proprietary interest in the name "Mxxxxxxx," and the Trust agrees to promptly take such action as may be necessary to delete from its corporate name and/or the name of the Series any reference to the name of the Adviser or the name "Mxxxxxxx," promptly after receipt from the Adviser of a written request therefore. 10.
Name of Adviser. The parties agree that the Adviser has a proprietary interest in the name “FPA,” and the Fund agrees to promptly take such action as may be necessary to delete from its corporate name and/or the name of the Funds any reference to the name of the Adviser or the name “FPA,” promptly after receipt from the Adviser of a written request therefore.

The Fund agrees that if this Agreement terminates for any reason it shall promptly take such action as may be necessary to delete from its corporate name and/or the name of the Portfolio any reference to the name of the Adviser promptly after receipt from the Adviser of a written request therefore.

The parties agree that the Adviser has a proprietary interest in the name "Mattxxxx," xnd the Trust agrees to promptly take such action as may be necessary to delete from its corporate name and/or the name of the Series any reference to the name of the Adviser or the name "Mattxxxx," xromptly after receipt from the Adviser of a written request therefore.

The parties agree that the Adviser has a proprietary interest in the name "Bjurman, Barry Small Cap Xxxxxx Xxxx," and the Trust agrees to promptly take such action as may be necessary to delete from its name and/or the name of the Trust any reference to the name of the Adviser promptly after receipt from the Adviser of a written request therefore.

The parties agree that the Adviser has a proprietary interest in the name "Sage/Tso Trust", and the Trust agrees to promptly take such action as may be necessary to delete from its name and/or the name of the Trust any reference to the name of the Adviser promptly after receipt from the Adviser of a written request therefore. 9.
Name of Adviser. Effective August 1, 2008, all references in the Agreement to Xxxxxxx & Co. NY Ltd. are hereby deleted and replaced with Xxxxxxx & Company N.Y. Ltd.

The parties agree that the Adviser has a proprietary --------------- interest in the name "Focus Trust, Inc." and the Corporation agrees to promptly take such action as may be necessary to delete from its corporate name and/or the name of the Corporation any reference to the name of the Adviser on the name "Focus Trust, Inc." promptly after receipt from the Adviser of a written request therefore.
