MOTION FOR FINAL APPROVAL. Not later than 16 court days before the calendared Final Approval Hearing, Plaintiff will file in Court, a motion for final approval of the Settlement that includes a request for approval of the PAGA settlement under Labor Code section 2699, subd. (l), a Proposed Final Approval Order and a proposed Judgment (collectively “Motion for Final Approval”). Plaintiff shall provide drafts of these documents to Defense Counsel not later than seven days prior to filing the Motion for Final Approval. Class Counsel and Defense Counsel will expeditiously meet and confer in person or by telephone, and in good faith, to resolve any disagreements concerning the Motion for Final Approval.
MOTION FOR FINAL APPROVAL a. Upon expiration of the Response Deadline, Class Counsel will file unopposed motions and memorandums in support thereof for Final Approval of the Settlement and the following payments in accord with the terms of the Settlement: (1) the Attorney Fee Award; (2) the Cost Award; (3) the Administration Costs; (4) the Class Representative Enhancement Payment; and (5) the PAGA Payment. Class Counsel will also move the Court for an order of Final Approval (and associated entry of Judgment).
MOTION FOR FINAL APPROVAL. No later than sixteen (16) court days before the calendared Final Approval Hearing, Plaintiff will file in Court a motion for final approval of the Settlement that includes a request for approval of the PAGA settlement under Labor Code section 2699, subd. (l), a Proposed Final Approval Order, and a proposed Judgment.
MOTION FOR FINAL APPROVAL. Within a reasonable time after the Bar Date to Opt Out, and provided the conditions in Section 16, below, are satisfied, Class Counsel shall file a Motion for Final Approval of this Agreement so that same can be heard on the Final Approval Hearing Date.
MOTION FOR FINAL APPROVAL. Plaintiffs must apply for Court approval of the Final Order and Judgment no later than the date set forth in the Preliminary Approval Order, which application shall request final approval of the Settlement Agreement. Unless otherwise agreed to by the Parties in writing, Co-Lead Counsel shall provide Defendant’s Counsel with drafts of the moving papers requesting final approval for review at least five (5) business days before the motion is filed.
MOTION FOR FINAL APPROVAL. At least 14 days prior to the Final Approval Hearing, or by some other date if so directed by the Court, Plaintiff will move for final approval of the Settlement Agreement.
MOTION FOR FINAL APPROVAL. Plaintiff shall move the Court for final approval of the Settlement no later than the deadline set by the Court in the Preliminary Approval Order, or as may be extended by the Court on application of the Parties. On or after the date set by the Court for the Final Approval Hearing pursuant to Federal Rule of Civil Procedure 23(e)(2), the Court shall determine, among other things, (a) whether to enter the Final Order and Judgment finally approving the Settlement; and (b) what, if any, Case Contribution Award and/or Attorneys’ Fees and Expenses should be awarded to Plaintiff and Class Counsel, respectively, pursuant to Sections 8.1 and 8.2 of this Agreement.
MOTION FOR FINAL APPROVAL. Class Counsel will obtain a hearing for a Motion for Final Approval, to obtain an order to (a) approve this Agreement, (b) adjudge its terms to be fair, 18 reasonable, and adequate, (c) recite the Released Claims, (d) direct that the terms of the Agreement be carried out, and (e) retain jurisdiction to oversee enforcement of this Agreement. Class Counsel will prepare the final settlement approval papers, which will also be subject to a five-court-day period for 21 Defendant’s review and comment before filing.
MOTION FOR FINAL APPROVAL. No later than 30 days prior to Final Approval Hearing Date (or such other date set by the Court), Class Counsel shall file a Motion for Final Approval of this Agreement so that same can be heard on the Final Approval Hearing Date.
MOTION FOR FINAL APPROVAL a. Class Counsel will file unopposed motions and memoranda in support thereof for Final Approval of the Settlement and the following payments in accord with the terms of the Settlement: (1) the Attorney Fee Award; (2) the Cost Award; (3) Administrative Costs; (4) the Class Representative Enhancement; and (5) PAGA Payment. Class Counsel will also move the Court for an order of Final Approval (and associated entry of Judgment) releasing and barring any Released Claims of the Participating Class Members and the PAGA Released Claims of the Eligible Aggrieved Employees.
