Motion for Class Certification. No later than September 13, 2019, in conjunction 11 with their Motion for Preliminary Approval, Plaintiffs shall move the Court for certification of the 12 Class for settlement purposes only. Defendants will not object to Plaintiffs’ motion for class 13 certification for settlement purposes only, pursuant to Federal Rule of Civil Procedure 23(a) and 14 23(b)(1). If the Court does not issue the Final Approval Order and Judgment, then no Class shall be 15 deemed to have been certified by or as a result of this Agreement, Defendants shall not be deemed 16 to have admitted the propriety of certification of the Class under any provisions of Federal Rule 23, 17 and the Actions shall for all purposes revert to their status on April 22, 2019 as to the Claims 18 against the Safeway Defendants, and May 2, 2019 as to the Claims against Aon.

Motion for Class Certification. On December 1, 2017, Defendant filed a second Motion for Partial Summary Judgment, which Plaintiff opposed on January 5, 2018, and in support of which Defendant filed a Reply on January 19, 2018. Plaintiff filed a Surreply on January 27, 2018. Plaintiff also filed a Motion to Strike Defendant’s second Motion for Summary Judgment on January 5, 2018, which Defendant opposed on January 19, 2018, and in support of which Plaintiff filed a reply on January 27, 2018.
Motion for Class Certification. Class Counsel shall move the District Court for class certification of the Settlement Class under Fed. R. Civ. P. 23(b)(1) as a non-opt-out class, with the Named Plaintiffs as the Settlement Class representatives, and Class Counsel as counsel for the Settlement Class.

  • Class Certification Solely for the purposes of this Settlement, the Parties stipulate and agree to certification of the claims asserted on behalf of Class Members. As such, the Parties stipulate and agree that in order for this Settlement to occur, the Court must certify the Class as defined in this Agreement.

CLEC’s failure to maintain such authorization(s) as may be required by Applicable Law for conducting business in the State as a CLEC shall be considered a Default of Agreement.
