Moratoria. There is no moratorium applicable to any of the Real --------- Property on (i) the issuance of building permits for the construction of houses, or certificates of occupancy therefor or (ii) the purchase of sewer or water taps.

Moratoria. Except as set forth on WP Disclosure Schedule Section 4.8(d), to the knowledge of the WP Partners and the WP Entities, there is no moratorium applicable to any of the WP Owned Real Property to the extent any of the WP Entities plans further development thereof on (A) the issuance of building permits for the construction of houses, or certificates of occupancy therefor, or (B) the purchase or issuance of sewer or water taps or permits, to the extent any of the WP Entities plans or is required to rely on public water or sewer facilities.
Moratoria. Except as set forth on Xxxxxxx Disclosure Schedule Section 5.8(d), to the knowledge of the Xxxxxxx Entities, there is no moratorium applicable to any of the Xxxxxxx Owned Real Property to the extent any of the Xxxxxxx Entities plans further development thereof on (A) the issuance of building permits for the construction of houses, or certificates of occupancy therefor, or (B) the purchase or issuance of sewer or water taps or permits, to the extent any of the Xxxxxxx Entities plans or is required to rely on public water or sewer facilities.
Moratoria. If, at the time of closing, there are sewer, water, building or other moratoria in effect which would interfere with the immediate construction and occupancy of the Project, then Buyer, at its sole option, may: (i) close the transaction without regard to the moratoria; or (ii) extend the closing for up to ninety (90) days. If at the end of the 90-day period the moratorium has not been removed, Buyer may elect to terminate the Contract and obtain a refund of the Deposit, together with any extention fees or postponement fees paid by Buyer pursuant to Section 4, whereupon the parties shall be relieved from all further liabilities and obligations hereunder. If the moratorium is lifted within the 90 day extention period, then the closing shall take place within 30 days after the date that the moratorium is lifted.
Moratoria. Except as specifically set forth in this section, City agrees that to the extent permitted by law, no moratorium or other similar limitation (whether relating to the rate, timing, or sequencing of the development of the Project or any part thereof and whether or not enacted by local initiative or otherwise) affecting subdivision maps, grading or building permits, occupancy certificates, or other entitlements approved, issued, or granted within the City, after the Effective Date of this Agreement, shall apply to the Project. Owner acknowledges and agrees that the provisions hereof shall not preclude the application to the Project of a moratorium or other similar limitation (of the type described in the preceding sentence) enacted in order to protect an imminent threat to the public health or safety.
Moratoria. In the event an ordinance, resolution, or other measure is enacted, whether by action of the City, the qualified voters, by initiative, or otherwise, which relates to the rate, amount, timing, sequencing, or phasing purportedly applying to the Development of the Project on all or any part of the Property or the implementation or construction of the Project, City agrees that, unless required by applicable state law, such ordinance, resolution, or other measure shall not apply to the Project, Property or this Agreement, unless such changes are adopted pursuant to the City’s exercise of its Reserved Powers.
Moratoria. The Project and the rights and obligations of Developer under this Agreement shall be subject to any regulation, ordinance or moratorium enacted by the City to respond to a bona fide threat to public health and safety and involving facts and circumstances beyond the reasonable control of the City, and which represent a compelling, countervailing public interest adopted pursuant to Utah Code Xxx. § 10-9a-504 (2022).

Moratoria. If at the time of Closing, there is a water, sewer, building or other moratoria in effect with respect to the Property which would interfere with the immediate construction of the Contemplated Improvements, then at Purchaser's option (by written notice to Seller), the Closing Date may be extended to the earlier of: (i) twenty (20) days from the date the moratoria is lifted; or (ii) six (6) months from the scheduled Closing.

Moratoria. To the best of Seller’s knowledge, there is no intended or proposed federal, state, or local statute, ordinance, order, requirement, law, or regulation (including, but not to, zoning changes or moratoria) or any plan, study or effort which may materially adversely affect the use or development of the Property; except that the Property would not be eligible to receive a State of Nevada non-restricted gaming license if non-restricted gaming operations were to cease at the Property for a period of eighteen (18) months.
