MONITORING THE SERVICE. ISP has no obligation to monitor the Service, but may do so and may disclose information regarding the use of the Service for any reason if ISP, in its sole discretion, believes that it is reasonable to do so, including but not limited to: satisfy laws, regulations, or governmental or legal requests; operate the Service properly; or protect itself and its Members. ISP may immediately remove your material or information from ISP's servers, in whole or in part, which ISP, in its sole and absolute discretion, determines to infringe another's property rights or to violate our Acceptable Use Policy.

MONITORING THE SERVICE. The effectiveness and efficiency of the service will be the subject to ongoing review and analysis. This may include premises inspections, monitoring of service standards, compliance with the agreement, auditing of test standards, etc. - The agreement may be terminated by the Council at any time where the Provider has repeatedly failed to comply with the requirements of this agreement. The Council will inform the Provider in writing on any occasion it considers it to have failed to comply outlining the reason/s why, and will where practicable provide 28 days’ written notice whereby termination is deemed necessary. However, where the Council considers the reason/s for termination to be of a serious nature and the notice period is therefore not appropriate, this decision can take immediate effect and will be communicated as such.

This decision will be final. Where a notice of termination is given with immediate effect, the Provider will not be permitted to operate under the terms of the contract until the appeal has been heard. Appendix N - Restricted Home to School Private Hire Driver’s‌ Licence The Council now issue licences for restricted Private Hire use on Home to School transportation through contracts issued by a Local Education Authority or Academy Trust. Holders of this licence will only be permitted to use the licence for this purpose and not for any other private hire or hire and reward work. The licensing process will be the same as for any other type of driver licence offered by the Council, however, the driver training course required to be undertaken as part of the application will be one which is tailored to the specific type of work that the driver will be carrying out, in substitute of the broader content covered within the course for other driver licence types. No licence will be granted to an applicant until evidence is provided confirming an approved contract with a Local Education Authority or Academy Trust is in place. The Private Hire Operator of the driver may produce this on their behalf. Holders of the licence will be subject to the licence conditions shown at Appendix E. MONITORING THE SERVICE. 19.2 The Chief Officers Group may request any information from CNWL, the Council, and the Manager necessary to carry out it’s function. CNWL, the Council and the Manager are obliged to comply with such requests.
