Money and Payments. 1.1.4.1 Sub-clause 1.1.4.1 shall be deleted and the following substituted.
Money and Payments. Accepted Contract Amount” means the amount accepted in the Letter of Acceptance for the execution and completion of the Works and the remedying of any defects. “Contract Price” means the price defined in GCC 14.1 [The Contract Price], and includes adjustments in accordance with the Contract. “Cost” means all expenditure reasonably incurred (or to be incurred) by the Contractor, whether on or off the Site, including overhead and similar charges, but does not include profit. “Final Payment Certificate” means the payment certificate issued under GCC 14.13 [Issue of Final Payment Certificate]. “Final Statement” means the statement defined in GCC 14.11 [Application for Final Payment Certificate]. “Foreign Currency” means a currency in which part (or all) of the Contract Price is payable, but not the Local Currency. “Interim Payment Certificate” means a payment certificate issued under GCC 14 [Contract Price and Payment], other than the Final Payment Certificate. „’Currency” means the currency of the Country. “Payment Certificate” means a payment certificate issued under GCC 14 [Contract Price and Payment]. “Provisional Sum” means a sum (if any) which is specified in the Contract as a provisional sum, for the execution of any part of the Works or for the supply of Plant, Materials or services under GCC 13.5 [Provisional Sums]. “Retention Money” means the accumulated retention moneys which the Employer retains under GCC 14.3 [Application for Interim Payment Certificates] and pays under GCC 14.9 [Payment of Retention Money]. “Statement” means a statement submitted by the Contractor as part of an application, under GCC 14 [Contract Price and Payment], for a payment certificate.

  • Costs and Payments During the period that Sprint PCS is curing a breach or operating the Service Area Network under this Section 11.6.3, Sprint PCS and Manager will continue to make any and all payments due to the other party and to third parties under this agreement, the Services Agreement and any other agreements to which such party is bound, except that Sprint PCS may deduct from its payments to Manager all reasonable costs and expenses incurred by Sprint PCS in connection with the exercise of its right under this Section 11.6.3. Sprint PCS' operation of the Service Area Network pursuant to this Section 11.6.3 is not a substitution for Manager's performance of its obligations under this agreement and does not relieve Manager of its other obligations under this agreement.
