Common use of Monetary Damages Clause in Contracts

Monetary Damages. Contractor is entitled to recover any compensation due under subsection 3.7, Payments, for Services provided in accordance with the Contract but not paid by the Department. Contractor is not entitled to, and will not seek, any other reimbursement or payment, or damages, including but not limited to lost profits, consequential or indirect costs or damages. Prior to the Department’s payment to Contractor as the result of termination, Contractor will have satisfied all undisputed obligations to third parties relating to the Contract.
