Common use of Modification of Premises Clause in Contracts

Modification of Premises. Effective as of the date (the “Expansion Commencement Date”) which is the earlier to occur of (i) the date Tenant commences to conduct business in the Expansion Premises, and (ii) the date the Expansion Premises are “Ready for Occupancy,” as that term is defined in Section 5,1 of the Tenant Work Letter attached hereto as Exhibit B (the “Tenant Work Letter”) (which date is anticipated to be July 1, 2010), Tenant shall lease from Landlord and Landlord shall lease to Tenant the Expansion Premises. Consequently, effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Premises. Landlord and Tenant hereby acknowledge that such addition of the Expansion Premises to the Existing Premises shall, effective as of the Expansion Commencement Date, increase the rentable square footage of the Premises to approximately 14,823.

Modification of Premises. Effective as of the date (the “Expansion Commencement Date”) which is the earlier to occur of (i) the date Tenant upon which Lessee first commences to conduct business in the Expansion Premises, and (ii) the date that occurs sixty (60) days following the date Lessor delivers exclusive possession of the entire Expansion Premises are (excluding the “Ready for OccupancyHoldback Space,” as that term is defined in Section 5,1 of the Tenant Work Letter attached hereto as Exhibit B (the “Tenant Work Letter”4.3, below) (which date is anticipated to be July 1Lessee, 2010), Tenant Lessee shall lease from Landlord Lessor and Landlord Lessor shall lease to Tenant Lessee the Expansion Premises. Consequently, effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Premises. Landlord Lessor and Tenant Lessee hereby acknowledge that such addition of the Expansion Premises to the Existing Premises shall, effective as of the Expansion Commencement Date, increase the rentable square footage area of the Premises to approximately 14,82328,655 rentable square feet. The Existing Premises and the Expansion Premises may hereinafter collectively be referred to as the “Premises.”

Consequently, effective upon the Expansion Commencement Date, the Existing Premises shall be increased to include the Expansion Premises. Landlord and Tenant hereby acknowledge that such addition of the Expansion Premises to the Existing Premises shall, effective as of the Expansion Commencement Date, increase the rentable square footage size of the Premises to approximately 14,82377,585 rentable square feet. The Existing Premises and the Expansion Premises may hereinafter collectively be referred to as the "Premises." Modification of Premises. Effective as of the date (the “Expansion Commencement Date”) which is the earlier to occur of ninety-one (i91) days following the date Tenant that Landlord commences to conduct business in the Expansion Premises, and construction of the “Improvements” (ii) the date the Expansion Premises are “Ready for Occupancy,” as that term is defined in Section 5,1 2.1 of the Tenant First Amendment Work Letter attached hereto as Exhibit B (the “Tenant First Amendment Work Letter”)) (which date is anticipated to be July 1in the Expansion Premises after the termination or expiration of the “Existing Lease” as provided in Section 11, 2010)below, Tenant shall lease from Landlord and Landlord shall lease to Tenant the Expansion Premises. Tenant acknowledges and agrees that the Expansion Commencement Date may occur prior to the “Substantial Completion of the Improvements” (as that term is defined in Section 5.4 of the First Amendment Work Letter). Consequently, effective upon the Expansion Commencement Date, the Existing Premises (as that term is defined in the Lease) shall be increased to include the Expansion Premises. Landlord and Tenant hereby acknowledge that such addition of the Expansion Premises to the Existing Premises shall, effective as of the Expansion Commencement Date, increase the rentable square footage size of the Premises to approximately 14,823128,580 rentable square feet. The Existing Premises and the Expansion Premises may hereinafter collectively be referred to as the “Premises.”
