Modification of Orders. No accepted purchase order will be modified or canceled except upon the written agreement of both parties. The Distributor’s purchase orders or mutually agreed change orders will be subject to all provisions of this Agreement, whether or not the purchase order or change order so states.
Modification of Orders an order of the Bankruptcy Court shall be entered reversing, amending, supplementing, replacing, staying for a period in excess of 10 days, vacating or otherwise modifying the Interim Borrowing Order or the Final Borrowing Order, as applicable, without the prior written consent of the Administrative Agent and the Majority Lenders; or
Modification of Orders. Medtronic may cancel or reschedule purchase orders for products only with MacroPore's prior written approval. Notwithstanding the foregoing, any purchase order may be cancelled by Medtronic as to any Developed Products that are not delivered within 60 days after the delivery date requested by Medtronic pursuant to a purchase order, and any such cancellation shall not limit or affect any contract remedies available to Medtronic with respect thereto. Any such cancellation by Medtronic must be by written notice to MacroPore given within 15 business days after such 60th day.

All order(s) placed with OMP by Distributor for Products shall be made on through the submission of a Purchase Order. Notwithstanding the content of Distributor’s purchase order, this Agreement shall take precedence over Distributor’s purchase order, and, subject to applicable law, in the event of any conflicting, inconsistent or additional terms of Distributor’s purchase order, the terms of this Section 6 shall prevail.

No accepted purchase order may be modified or canceled later than thirty (30) days before the scheduled delivery date, except upon the written agreement of both parties, provided, however, any price decrease for the Products shall be implemented upon the effective date of such decrease and therefore, will apply to any purchase order for which delivery has not yet taken place. Furthermore, Vital Images will, at no additional cost to Toshiba and the Dealer Associate, ship its latest authorized version or release of a Product in response to any accepted purchase order. Toshiba’s and the Dealer Associate’s purchase orders or mutually-agreed change orders shall be subject to all provisions of this Agreement, whether or not the purchase order or change order so states, and any terms and conditions of such purchase order or change order which conflict with the terms and conditions of this Agreement shall be deemed excluded and of no legal effect as between the parties.
Modification of Orders. Purchase Orders may be modified by written notice to Seller up to four (4) weeks prior to the Delivery Date required in such Purchase Order.
Modification of Orders. 8.1 Taken with this Agreement, orders for Work received from Customer constitute the complete and final agreement between Precision and the Customer. Each order for Work shall be governed by this Agreement and each such order shall constitute a separate agreement between Precision and Customer. While the parties may agree in writing to a change in the scope of services or equipment supplied under an order, no purchase order or other document provided by Customer in any way modifying any of the terms and conditions contained herein will be binding upon Precision.
Modification of Orders. Buyer is entitled to modify the Order and the quantity and delivery date, in particular if the modification is necessary to satisfy Buyer’s customer’s change request. The modification shall be considered as accepted if the Supplier does not respond otherwise in writing within three business days after receipt. Partial deliv- eries and excess deliveries are only permitted if they have been agreed on in writing.
