Misuse of Sick Leave. Sick leave is a benefit protecting our employees against the financial burden of illness. Any proven misuse or abuse of sick leave will subject the employee to disciplinary action including discharge.
Misuse of Sick Leave. If the principal or his/her superiors find that the professional employee has violated or misused this sick leave, the principal may require the employee to provide a signed statement attesting to his/her illness from a licensed physician for any subsequent absences. The employee will be notified in writing of this requirement, along with the reasons for such a decision. A copy of this notification will be sent to the Association. This requirement will remain in effect until the end of the school year or until revoked by the principal, whichever is the shorter period. In the event that it can be shown that a professional employee violated or misused this sick leave policy or misrepresented any statement or condition under this policy, he/she may be subject to a reprimand and/or forfeiture of pay for the day or days absent.
Misuse of Sick Leave. When the Superintendent/designee determines that potential misuse of sick leave may exist, a meeting will be arranged with the unit member, administration, and a representative of the Association. The purpose of the meeting will be to discuss the potential misuse of sick leave and to provide the unit member an opportunity to explain, rebut or refute the suspected misuse. If a satisfactory explanation is not provided, action will be taken by the Board, including, but not limited to corrective counseling and progressive discipline. Falsification of a sick leave statement shall be grounds for serious disciplinary action, including potential termination of employment.

Application for sick leave with the intent to defraud will result in dismissal and refund of salary or wages paid. Misuse of Sick Leave is cause for disciplinary action up to and including discharge. The Employer may investigate cases of suspected sick leave misuse and may at any time during the course of that investigation and to the extent allowed by law request the employee provide verification that the employee’s use of sick leave is for an authorized purpose as set forth in this article.
