MINISTRY INITIATIVES. The parties acknowledge the ongoing implementation of the children’s Mental Health Strategy, the Special Needs Strategy, and other initiatives within the province of Ontario. The parties further acknowledge the importance of initiatives being implemented within the provincial school system including but not limited to the addition of Mental Health Leads, and the protocol for partnerships with external agencies/service providers. It is agreed and affirmed that the purpose of the initiatives is to enhance existing mental health and at risk supports to school boards in partnership with existing professional student services support staff and other school personnel. It is not the intention that these enhanced initiatives displace CUPE workers, nor diminish their hours of work. LETTER OF UNDERSTANDING #12 BETWEEN The Canadian Union of Public Employees (Hereinafter ‘CUPE’) AND The Council of Trustees’ Associations (Hereinafter the ‘CTA/CAE’) AND The Crown RE: Provincial Working Group – Health and Safety The parties confirm their intent to continue to participate in the Provincial Working Group – Health and Safety in accordance with the Terms of Reference dated May 25, 2016 including any updates to such Terms of Reference. The purpose of the working group is to consider areas related to health and safety in order to continue to build and strengthen a culture of health and safety mindedness in the education sector. Where best practices are identified by the committee, those practices will be shared with school boards. Areas for discussion may include:  Violence in the Workplace;  Occupational health and safety training, including training for CUPE members;  Caring and Safe Schools as it relates to CUPE members;  Health and safety considerations in high risk areas of the school; and  Any other health and safety matters raised by either party. The Crown commits to convene a meeting of the Working Group prior to December 31, 2015. CUPE will be entitled to equal representation on the Provincial Health and Safety Working group. MINISTRY INITIATIVES. The parties confirm that the Principals’ and Vice-Principals’ associations will continue to participate in the Ministry Initiatives Committee and Transformation Team. In addition, the parties confirm participation in a working group to:  engage in the continuation of the dialogue focused on the Principal and Vice-Principal workload studies and related issues;  review and evaluate the effectiveness of the Ontario Leadership Strategy and Professional Learning Enhancements: Mentoring for All and discuss whether there are more effective ways to allocate resources to support the Principalship; and,  identify and discuss issues related to the future role of the Principalship. The working group will establish its own process which may include developing terms of reference. MINISTRY INITIATIVES.  ETFO will be an active participant in the consultation process to develop a Ministry of Education Policy/Program Memorandum about Ministry and school board initiatives  Any new provincial initiatives that would impact on workload, classroom quality or testing/data collection will not be introduced prior to August 31, 2016  Central committee created with representatives from teacher federations and school boards to discuss new initiatives, including the implications for training, resourcing and timing  School boards must create a process, or use an existing process, to xxxxxx consultation, collaboration and communication with ETFO regarding the implementation of new initiatives PROFESSIONAL JUDGEMENT  The definition of teacher professional judgement in relation to assessment and evaluation enshrined in collective agreement  School boards to provide a list of pre-approved assessment tools  Teachers to use their professional judgement to determine which assessment tools will be used, as well as frequency and timing of the use of assessment tools  Results of diagnostic assessments shall not be used to evaluate, discipline or discharge teachers/occasional teachers JUNIOR/INTERMEDIATE CLASS SIZE/STAFFING LEVELS  Committee formed (with representatives from ETFO, OPSBA and Ministry) to review grade 4-8 class sizes during the 2015-2016 school year and make recommendations for potential areas of improvement.  Review to include: o analysis of existing class size data and boards’ level of compliance o identification of issues relating to non-compliance o development of options to address non-compliance FDK CLASS SIZE/STAFFING LEVELS  Boards are to make every effort to limit Full Day Kindergarten/Grade 1 split grades where feasible  Full Day Kindergarten: Ministry to undertake a review of FDK staffing and class size, in conjunction with ETFO and school boards, with recommendations for improvement  Ministry to monitor FDK class size for compliance with “Ontario Regulation 132/12 – Class Size”  Ministry to review any situations with ETFO and school boards where there is a class greater than 30 students and fewer than 16 in the same school  Ministry to provide data on FDK class size to ETFO and OPSBA twice per year (September, March)
