Common use of Minimum Fee Clause in Contracts

Minimum Fee. The minimum annual total of Monthly Fees paid by FRANCHISEE (the "Minimum Fee") shall be as specified in Section 5 of Exhibit A. If in any Agreement Year, the total Monthly Fees paid by FRANCHISEE in such Agreement Year are less than the Minimum Fee for such Agreement Year provided herein, FRANCHISEE agrees to pay to COMPANY an amount equal to the difference between the Monthly Fees paid and the Minimum Fee for such Agreement Year. Such amount shall be paid by FRANCHISEE to COMPANY within thirty (30) days after the last day of such Agreement Year.
