Minimum Break Clause Examples

Minimum Break. An employee must have an eight (8) hour break between the work on consecutive days. If so much overtime is worked that an eight (8) hour break is not possible, then all work performed until an eight (8) hour break is possible shall be at the rate of double time for ordinary hours performed.
Minimum Break. An Employee shall be entitled to a minimum break between the end of one working day and the start of the next working day as prescribed by the Award.
Minimum Break a) Employees are entitled to a ten (10) hour break between completion of work and the commencement of their next shift. b) The employee is to be released from duty for such time as the employee has had ten (10) hours off duty. Where this cannot occur due to exceptional circumstances, the employee is to be paid at double the ordinary rate until a ten (10) hour break can be taken. c) Health and safety will be the prime consideration in determining whether the employee is to attend work without a ten (10) hour break. d) In the case of employees whose shift roster includes the working of twelve (12) hour shifts, those employees must have a minimum of a ten (10) hour break.
Minimum Break. 7.11.1 An Employee is entitled to a minimum break of 10 hours off duty between shifts, regardless of whether or not such shifts are worked for the same Employer; provided that a break of less than 10 hours may be taken by mutual agreement between the Employer and the Employee.
Minimum Break. (a) The Employer will use its best endeavours to ensure a minimum break of: Nine (9) hours between shifts and: Ten (10) hours between a call-in and the commencement of another shift except where the first call in is after 4.30am. (b) An employee will be released from work without loss of pay until they have had 10 hours break in accordance with (a) above. The employee will therefore not attract a loss of pay for rostered hours (if they cannot return to resume) but will be expected to return to their rostered site to resume their duties after the minimum break period. (c) Furthermore, if the employee is unable to take the minimum break and is directed to work by management, overtime rates will apply until relevant minimum break is taken. (d) Overtime rates will not apply where an employee voluntarily commences a new shift without having taken the requisite minimum break, due to staff choosing to swap shifts to suit personal requirements.
Minimum Break a) Employees are entitled to a minimum break of 9 consecutive hours off duty between the work of successive duties. Where an employee receives less than the minimum break the employee will be paid at the appropriate overtime rate for all hours worked on recommencing duty up until a break of 9 consecutive hours can be taken e.g.: The employee has worked 0645hours to 1515hours and is requested to undertake call back to work from 1800 hours to 2315 hours and shall be paid at
Minimum Break. All employees shall be entitled to a ten hour break between the end of one rostered shift and the commencement of the next shift (or part shift). The employee has the right to waive the ten hour break, providing that a break of less than 10 hours does not place their and others health and safety at risk. The final decision will however rest with the Company. Where the time between one such shift and another is less than ten hours, the second shift shall be paid at double ordinary time rates unless the shift is delayed until 10 hours has elapsed, without loss of ordinary pay for the employee. The employee will notify the Company when requested to work overtime in the case that in accepting the overtime offered a ten hour break would not be available before the commencement of the next rostered shift. This will ensure that the Manager can seek approval for overtime for the next rostered shift or determine a variation as required. The manager is to record on the operations overtime form if there will be no 10 hour break and the Operations Manager’s approval. The employee will not be entitled to overtime if such notification is not supplied and the employee is aware that in accepting the overtime it would be incurred.
Minimum Break. An employee who works so much overtime between the termination or ordinary work on one day and the commencement of ordinary work on the next day that such employee has not had at least ten (10) hours off duty between those times, shall, subject to this subclause, be released after the completion of such overtime until the employee has had ten (10) hours off duty without loss of pay for ordinary working time occurring during such absence. If on the instructions of the employer such an employee resumes or continues work without having had ten (10) hours off duty the employee shall be paid at double ordinary time until released from duty for ten (10) hours and such employee shall then be entitled to be absent until the employee has had ten (10) hours off duty without loss of pay for ordinary working time occurring during such absence.
Minimum Break a) After completing overtime, an employee is either to be released from duty on normal pay for such time as the employee has had ten (10) hours off duty or the employee is to be paid at double the ordinary rate (2x) until a ten (10) hour break can be taken. If the time worked on any separate occasion when an employee is called back to work is less than the specified minimum hours outlined in subclause 6.3 d), it is not considered when deciding whether the employee has had 10 hours rest, except as outlined in subclause
