Milestone 4. Upon the Parties’ joint confirmation of STRATEC’s completion of the activities resulting in the availability of LSR Validation Instruments for acceptance testing in accordance with Milestone 5 (including QTX’s receipt of an LSR Validation Instrument and evidence that Shipping Criteria have been met), STRATEC shall provide QTX with a written notice thereof. STRATEC invoice QTX for the amount due and shall be entitled to receive the Warrants as set forth above. QTX shall remit Payment to STRATEC and issue the Warrants earned within thirty (30) days of receipt of the invoice and provide an enforceable document evidencing the Warrants earned.
Milestone 4. As soon as practicable after the Buyer announces to the ASX that Milestone 4 has been achieved, the Buyer must give written notice to the Sellers to that effect (Milestone 4 Notice), and the Milestone 4 Consideration will be payable in accordance with clause 7.12.

Milestone 4. Upon STRATEC’s completion of the prototype phase (Milestone 4) STRATEC shall provide Gen-Probe with a written notice thereof including evidence that Shipping Criteria have been met. Within 10 working days after Gen-Probe’s receipt of such notice Gen-Probe is requested to (i) release the shipment of the Panther Prototype unit(s) or (ii) ***Confidential Treatment Requested to decline STRATEC’s achievement of Shipping Criteria, providing STRATEC with a detailed written justification thereof. If Gen-Probe declines STRATEC’s achievement of Shipping Criteria the procedure as outlined in section (i) of this paragraph shall apply. If Gen-Probe releases the shipment of the Panther Prototype unit(s) or fails to decline STRATEC’s achievement of Shipping Criteria within 10 working days after Gen-Probe’s receipt of STRATEC’s notice STRATEC shall be allowed to both ship the Panther Prototype unit(s) and invoice Gen-Probe for the amount due. Gen-Probe shall remit Payment to STRATEC within thirty (30) days of receipt of the invoice.
Milestone 4. Contractor defined milestones The Contractor shall provide a work breakdown structure including comprehensive and integrated timelines (Gxxxx chart) and major milestones to complete the remaining the scope of work as relevant given the stage of antiviral development and evaluation toward product licensure. The Contractor shall propose milestones at which time data will be presented summarizing results of prior activities and new plans and protocols that will be submitted for review and approval in order to guide all subsequent activities. Potential milestones may include FDA acceptance of an IND application, production of investigational lots of antiviral drugs validation of QC lot release product methods, validation of manufacturing processes, stability study programs, consistency lot manufacturing, completion of clinical trials and progress to a new phase of antiviral drug evaluation, submission of a licensure application.
Milestone 4. On or before October 31, 2011, the Borrower shall provide to the Agent a detailed written plan, based on the Financial Model, for the deleveraging, restructuring or refinancing of the Group that shall include an assessment of capital markets refinancing options and be based on reasonable assumptions which are set out in detail. The plan shall thereafter be presented by the Borrower to the Lenders at a Lender meeting on a date to be agreed between the Agent, the Lenders and the Borrower.
Milestone 4. Licensee shall complete (i.e., dosing of final patient and data lock) Phase III Clinical Trials for at least one Licensed Product within the Field on or before thirty-six (36) months from the completion of Phase II.
