METHODS AND EQUIPMENT. Add the following after the second paragraph: “Equipment which the Engineer feels could damage Thruway Facilities shall not be allowed to operate until adequate protective measures are provided such as wooden mats, bridging devices or rubber pads. The Engineer’s approval of such protective devices shall not relieve the Contractor from responsibility for damage. The Contractor shall be responsible for keeping equipment in good working condition. Operators shall be knowledgeable in all aspects of equipment operation and shall know the limitations of the equipment. Under no circumstances, including changed or unforeseen work conditions, shall the Authority be held responsible or reimburse the Contractor for equipment damaged or broken during the progress of this Contract.”
