Method of Performing the Work. When measurements are affected by conditions already established or where items are to be fitted into constructed conditions, it shall be the Design-Build Firm's responsibility to verify all such dimensions at the site and the actual job dimensions shall take precedence. Communication and coordination between the Project Manager, Consultant , and the Design-Build Firm is key to successful execution and completion of the Work. If the Project Manager or Consultant reasonably determines the rate of progress of the Work is not such as to ensure its completion within the designated completion time, or if, in the opinion of the Project Manager the Design-Build Firm is not proceeding with the Work diligently or expeditiously or is not performing all or any part of the Work according to the Project schedule accepted by or determined by the Project, the Project Manager shall have the right to order the Design-Build Firm to do either or both of the following: (1) improve its work force; and/or (2) improve its performance in accordance with the schedule to ensure completion of the Project(s) within the specified time. The Design-Build Firm shall comply with such orders at no additional cost to the City, within seven calendar days upon the receipt of a “Notice to Cure”; (3) The City at its sole option may also have Work performed by a third party Design-Build Firm and deduct such cost from any monies due the Design- Build Firm. Where materials are transported in the performance of the Work, vehicles shall not be loaded beyond the capacity recommended by the vehicle manufacturer or permitted by Federal, State or local law(s). When it is necessary to cross curbing or sidewalks, protection against damage shall be provided by the Design-Build Firm and any damaged curbing, grass areas, sidewalks or other areas shall be repaired at the expense of the Design-Build Firm to the satisfaction of the Project Manager and Consultant. The Contractor shall comply with the manufacturer’s requirements for the handling, delivery and storage of all equipment and materials. Contractor shall inspect all equipment and materials immediately prior to installation and shall not install any damaged or defective items. Contractor shall comply with the manufacturer’s applicable instructions and recommendations for the performance of the Work, to the extent that these instructions and recommendations are more explicit or more stringent than requirements indicated in the Contract. All requests for such interruption or obstruction must be given in writing to the Project Manager twenty- four (24) hours in advance of the interruption of Town operations.

The Work to be performed shall be done in such a manner so as not to interfere with the normal Town operations. There shall be no obstruction of Town services without the prior written approval of the Project Manager. The Contractor shall protect public and private property, and utilities from injury or loss arising in connection with the Work, and take all necessary precautions to prevent accidents, injuries, or damage to persons or property on or near the Work. The Contractor shall be responsible for, and shall replace and make good all loss, injury, or damage to any property (including landscaping, irrigation, walks, drives, structures or utilities). Contractor shall be responsible for documentation including photos of the work site before and after the authorized services/work is conducted to verify property’s pre-existing and post-existing condition.

  • Method of Performing Services Contractor will determine the method, details, and means of performing the above-described services including measures to protect the safety of the traveling public and Contractor’s employees.   • Standard of Performance Consultant represents and warrants that it has the qualifications, experience and facilities necessary to properly perform the services required under this Agreement in a thorough, competent and professional manner.   • Continuing the Work The Contractor shall carry on the Work and adhere to the progress schedule during all disputes, disagreements or alternative resolution processes with the Owner. The Contractor shall not delay or postpone any Work because of the pending resolution of any disputes, disagreements or processes, except as the Owner and the Contractor may agree in writing.

  • Conditions Affecting the Work The Contractor shall be responsible for having taken steps reasonably necessary to ascertain the nature and location of the Work, and the general and local conditions, which can affect the Work or the cost thereof for any Job Order. Any failure by the Contractor to do so will not relieve him from responsibility for successfully performing the Work without additional expense to the County. The County assumes no responsibility for any understanding or representations concerning conditions made by any of its officers or agents prior to the execution of this Contract, unless such understanding or representations by the County are expressly stated in the Contract.

  • Method of Billing Consultant may submit invoices to the City for approval on a progress basis, but no more often than two times a month. Said invoice shall be based on the total of all Consultant’s services which have been completed to City’s sole satisfaction. City shall pay Consultant’s invoice within forty-five (45) days from the date City receives said invoice. Each invoice shall describe in detail, the services performed, the date of performance, and the associated time for completion. Any additional services approved and performed pursuant to this Agreement shall be designated as “Additional Services” and shall identify the number of the authorized change order, where applicable, on all invoices.

For the purposes of this Agreement, actions taken or not taken by the subcontractor, and Services provided by the subcontractor, will be deemed actions taken or not taken by the HSP, and Services provided by the HSP.
