Meter Accuracy. All metering equipment measuring the output of the Facility shall be tested once annually, at the Seller’s expense, in accordance with Good Utility Practice. At any reasonable time, either Party may request a test of the accuracy of any metering equipment. Each Party shall bear the cost of a test requested by it. The results of meter calibrations or tests shall be available for examination by the Parties at all reasonable times. If, at any time, any metering equipment is found to be inaccurate by more than one-half of one percent (0.5%), the Seller shall cause such metering equipment to be made accurate or replaced as soon as possible. Each Party shall be given reasonable advance notice of and have the right to be present at the breaking of the seals, testing, calibration and sealing of meters. If either Party believes that there has been a meter failure or stoppage, it shall immediately notify the other Party. The Party owning the meters will then investigate and take corrective action if necessary.

Meter Accuracy. 13.5.1 If a Party disputes the accuracy of the Export Meter it may give notice in writing to the other whereupon either Party shall be entitled to have the Export Meter examined and tested by an expert agreed upon by the Parties (or, in default of agreement, appointed by the President for the time being of the Institute of Electrical Engineers). The permitted margins of error for the Export Meter shall be those specified in the BSC. The costs of the expert, and of the examination and test, shall be borne by the disputing Party unless the expert determines that the Export Meter is inaccurate by a greater margin than the aforementioned permitted margins of error, in which case such costs shall be payable by the Generator.

Claim Handling To exercise its rights under this Warranty, the customer must notify Xxxxx Metering in writing at xxxxxxxx-xxx-xxxx@xxxxx.xxx and provide the name of the Product, the serial number, the specific defect, other relevant details, and customer’s contact information. The customer may include test results, as long as such test results adhere to the standards set forth under “Testing” below. In case the customer does not include test results, the submission of a claim by the customer shall be deemed as the customer’s consent to the performance of such tests by Xxxxx Metering, as Xxxxx Metering deems necessary or advisable, at the sole expense of the customer. Any claim submitted by customer under this Warranty shall include a copy of the applicable proof of purchase and delivery note. At Xxxxx Metering’s sole discretion, the defective Product shall be shipped by the customer prepaid F.O.B. to the nearest Xxxxx Metering factory or distribution center, as communicated by Xxxxx Metering from time to time (Incoterms® 2020). Any return delivery has to be agreed and coordinated with Xxxxx Metering beforehand. If requested by Xxxxx Metering, the customer shall furnish proof that the Products were installed by customer or an authorized installer in full compliance with the Product specifications, the installation manual, or any other written instructions by Xxxxx Metering, and provide Xxxxx Metering with any other information reasonably required by Xxxxx Metering. Testing Test results must be obtained according to AWWA standards and the HYDRUS BULK Testing Instruction, which can be obtained from Xxxxx Metering.

Meter Accuracy. Customer shall ensure the accuracy of its Meters and Water Meters. With reasonable notice, City shall have the right to inspect Customer's Meters and Water Meters and check for proper operation, including inspection of records. The accuracy of the Meters and Water Meters shall be reviewed on a regular basis and findings compared to the then best available technology. In the event that the accuracy of a Meter or Water Meter is found to be unsatisfactory, Customer, as soon as practicable, will repair, rehabilitate or replace its Meters or Water Meters.
