MEMBER’S RIGHTS. Each Member shall have the following right:

In addition to all other rights and remedies that a Member may have at law and in equity, including, but not limited to, under the Act, a Member may bring any action against the Manager, another Member and/or the Company to enforce the terms and provisions of this Agreement, to obtain a judgment for damages for a breach of this Agreement, and/or to cause the Manager and/or a Member to perform its obligations under this Agreement.
MEMBER’S RIGHTS. 28.1 Members shall have access to all of their personnel records at reasonable times (0830 - 1600 hours), Monday to Friday, and shall, upon request, be provided with copies of material contained in such records, which shall be corrected if inaccurate, or purged if inappropriate; and where a dispute arises and satisfactory settlement cannot be reached, recourse shall be sought through the grievance procedure.
MEMBER’S RIGHTS. 20.1 Members of the Portland Police Department hold a unique status as public officials, and the security of the City and its citizens depends to a great extent upon the manner in which members of the Department perform their manifold duties. The performance of such duties involves the members in all manner of contacts and relationships with the public. Out of such contacts and relationships may arise questions concerning the actions of members of the force. Such questions may require prompt investigation by Superior Officers designated by the Chief of Police or other competent authority.
MEMBER’S RIGHTS. No provision in this Agreement will be construed to deny or to restrict the rights granted to unit members under state and federal laws and regulations. The rights granted to unit members by this Agreement will be deemed to be in addition to those specifically provided in District policy.

MEMBER’S RIGHTS. The Chief or Deputy Chief shall be responsible to ensure that all allegations of misconduct and other violations shall be investigated. Such investigation shall be completed within a reasonable time based upon the circumstances or the alleged misconduct and the investigation. If the investigation is as a result of a complaint from the public, misconduct or other violations that come to the attention of a superior officer, the following procedure shall be followed: Upon receipt/knowledge of an allegation of misconduct or other violations(s) by a member, the Lieutenant or Sergeant of the Office of Professional Standards (OPS) will seek to determine if there are recordings or reports related to the circumstances surrounding the allegation. The Lieutenant or Sergeant will consider several issues, including but not limited to, the following before moving forward:

YOU ARE ENTITLED TO A COPY OF THIS AGREEMENT AT THE TIME YOU SIGN IT, YOU MAY CANCEL THIS AGREEMENT AT ANY TIME BEFORE MIDNIGHT OF THE THIRD DAY AFTER RECEIVING A COPY OF THIS AGREEMENT. IF YOU CANCEL THIS AGREEMENT WITHIN THE THREE–DAY PERIOD, YOU ARE ENTITLED TO A FULL REFUND OF YOUR MONEY LESS AN AMOUNT EQUAL TO THE VALUE OF ANY SERVICES RECEIVED AT THE STANDARD RATES THAT OTHERWISE WOULD HAVE BEEN CHARGED BY THE COMPANY IF YOU HAD NOT PURCHASED A MEMBERSHIP. IN THE EVENT THAT THERE IS A BALANCE DUE TO THE COMPANY FOR SERVICES PROVIDED AND YOU TERMINATE YOUR MEMBERSHIP IN ACCORDANCE WITH THIS SECTION 7, YOU AUTHORIZE THE COMPANY TO CHARGE YOUR CREDIT CARD FOR ANY SUCH AMOUNTS DUE. IF THE THIRD DAY FALLS ON A SUNDAY OR A HOLIDAY, NOTICE IS TIMELY GIVEN IF MAILED OR DELIVERED AS SPECIFIED IN THIS NOTICE ON THE NEXT DAY FOLLOWING A SUNDAY OR HOLIDAY, AS APPLICABLE. REFUNDS MUST BE MADE WITHIN THIRTY DAYS OF RECEIPT OF THE CANCELLATION NOTICE BY THE COMPANY. ALL CANCELLATION REQUESTS MUST BE SUBMITTED BY COMPLETING THE ONLINE PASSPORT TERMINATION FORM (AVAILABLE AT XXX.XXXXXXXXXX.XXX/XXXXXXXXXX-XXXXXXXXXXX/).
MEMBER’S RIGHTS. A. Under this article, a member holding a permanent assignment in more than one department has the same rights and privileges of regular members of the involved departments.

Pursuant to Chapter 123, Public Laws 1974, the District hereby agrees that every member of the Unit shall have the right freely to organize, join and support the Association and its affiliates for the purpose of engaging in collective negotiations and other concerted activities for mutual aid and protection. Every member of the unit shall also have right to refrain therefrom.
