Mediation or Arbitration. 24 (A) If the parties mutually desire to submit a grievance to mediation, they shall 25 retain the services of a mutually agreeable mediator. If mediation does not 26 resolve the matter, the Union has the right to submit the grievance to 27 arbitration. The Union will have ten (10) days from when the mediation is 28 stated, in writing, to be unsuccessful, to notify the City of its intent to proceed to 29 arbitration.
