Maximum Settlement Amount. As consideration, Defendant agrees to pay a non- reversionary maximum amount (“Maximum Settlement Amount”) of $169,000.00 in full and complete settlement of this matter, as follows:
Maximum Settlement Amount. Defendant’s total payment under this Settlement is $125,000.00, and under no circumstances shall Defendants be required to pay more than this amount in settlement of this Action.
Maximum Settlement Amount. The aggregate amount of TJX’s payment obligation under this Settlement Agreement shall not in any event exceed $23,989,750 (the “Maximum Settlement Amount”), which amount is subject to reduction as provided in Section 3.4 below.
Maximum Settlement Amount. Subject to the terms and conditions of this Agreement, the maximum amount, “Maximum Settlement Amount,” excluding payroll taxes, that Defendant is obligated to pay under this Settlement Agreement is One Million Three Hundred Seventy-Five Thousand Dollars ($1,375,000).
Maximum Settlement Amount. Defendants’ total aggregate payments under this Agreement shall under no circumstances exceed the Maximum Settlement Amount.
Maximum Settlement Amount. Subject to the other terms and conditions 15 contained in this Agreement, and in consideration of the contemplated pleadings, releases and 16 dismissals set forth in this Agreement, and subject to Court approval, Defendant agrees to pay the 17 Maximum Settlement Amount of Six Hundred Sixty-Two Thousand Four Hundred Thirty Six Dollars 18 and Zero Cents ($662,436.00).
Maximum Settlement Amount. “Maximum Settlement Amount” shall mean Eight Hundred Thirty-Five Thousand Dollars ($835,000.00) inclusive of all attorneys’ fees, litigation costs, claims administration fees, and incentive payments to Named Plaintiffs.
Maximum Settlement Amount. The Parties agree to settle this Action for total payment of Two Million Three Hundred Thousand U.S. Dollars ($2,300,000.00) (“Maximum Settlement Amount”), without reversion or discount. Defendants shall cause their insurers to pay the Maximum Settlement Amount. The Maximum Settlement Amount includes (1) attorneys’ fees of Class Counsel, (2) litigation costs and expenses of Class Counsel (which includes, without limitation, all such fees and costs incurred to date, as well as such fees and costs to be incurred in documenting the settlement, securing Court approval of this Settlement Agreement, and obtaining judgment in the Action), (3) the Service Payment to the Class Representative, as approved by the Court, and (4) all costs of administration, including, without limitation, settlement administration fees and expenses, all amounts due to the Settlement Administrator, etc. There shall be no further monetary payment from Defendants or any Released Party, and the Maximum Settlement Amount is inclusive of any payments or disbursements ordered by the Court.
Maximum Settlement Amount. Defendants’ maximum payment under this Settlement is $1,290,000.00. Defendants will pay this entire amount to the Administrator within seven (7) business days after the Effective Date. Any circumstances that require Defendants to pay more than this amount constitute a change to a material term.
