Manpower Requirements. At any time during the period for completion of the Work, the District may determine in its reasonable discretion that the Contractor or any of its subcontractors is not employing sufficient manpower on the Work to reasonably complete the Work or any component thereof within the scheduled amount of time. In such event, within forty‐eight hours of any request by the District, the Contractor shall provide such additional manpower, or shall ensure that the subcontractor provides such additional manpower, as the District determines is necessary to ensure completion of the Work in a timely manner. Any failure by the Contractor or subcontractor upon the District’s request to provide such additional manpower as is required by the District shall constitute grounds for termination of the Contractor and/or the subcontractor. As an alternative to termination, the District, in its sole discretion, may determine to supplement the workforce of the Contractor or the subcontractor in order to ensure timely completion of the Work, and the cost thereof shall be deducted from amounts due to the Contractor pursuant to the Contract, and no such action by the District shall be deemed or construed to constitute interference by the District with the Contract or the Contractor’s right to perform the Work.

In such event, within 5 business days of any written request by the District, the Contractor shall provide such additional manpower, or shall ensure that the subcontractor provides such additional manpower, as the parties mutually agree upon as reasonable and necessary to timely complete the Work. Any failure by the Contractor or subcontractor to comply with the terms of this provision shall constitute grounds for termination of the Contractor and/or the subcontractor. As an alternative to termination, the District, in its sole discretion, may determine to supplement the work-force of the Contractor or the subcontractor in order to ensure timely completion of the Work. If the parties mutually agree to the cost(s) incurred by the District herein, then the cost(s) shall be deducted from amounts due to the Contractor pursuant to the Contract, and no such action by the District shall be deemed or construed to constitute interference by the District with the Contract or the Contractor's right to perform the Work. Provided however, if the parties cannot agree on the cost(s) incurred by the District, then the District may withhold any disputed amounts pending resolution by the parties as provided for in Part 12 of the General Conditions.

Therefore RP will be requested to be on Site during the first week of the Outage for Permit to Work purpose (Project Manager will notify the Contractor/Partner) • Estimated Manpower list will be requested before any activity commence and estimated budget cost will be requested for all unknown scopes such as welding repairs, other repairs that might be discovered during inspections etc • Manpower will be increased or reduced based on the activities that needs to be executed. • Additional UT, PMI, Hardness test and any other NDT will be paid based on the hours worked on each activity (Call out rates will not apply on this contract). • Each activity needs to be completed as per planned Program/Schedule, any activity completed outside planned Program/Schedule will not be compensated. • Activities that cannot be done on time as per planned Program/Schedule due to access to plant areas will be treated based on the Hourly Rate (standing time will be compensated only for the hours lost). But take into consideration that there might be other activities that can be done while waiting for the other activities. • In case if there is no spares available, Project Manager will release the Manpower and advice the Contractor/Partner about the availability of the spares or will keep the Manpower that can able to execute the remaining activities if the Contractor/Partner have commitments on the other Projects. • Any additional work that might come into Contractor/Partner attention must be addressed to the Project Manager for approval.
