Common use of Manner of enforcement Clause in Contracts

Manner of enforcement. If the Transaction Security is being enforced pursuant to Clause 12.3 (Enforcement Instructions), the Security Agent shall enforce the Transaction Security in such manner (including, without limitation, the selection of any administrator of any Debtor to be appointed by the Security Agent) as the Enforcing Senior Creditors shall instruct in the Enforcement Notice or, in the absence of any such instructions, in accordance with paragraph (c) of Clause 12.3 (Enforcement Instructions) and the Security Enforcement Principles, and in any case always pursuant to the Security Enforcement Objective.

Manner of enforcement. If the Transaction Security is being enforced or other action as to Enforcement is being taken pursuant to Clause 12.3 13.3 (Enforcement Instructions), the Security Agent shall enforce the Transaction Security or take other action as to Enforcement in such manner (including, without limitation, the selection of any administrator of any Debtor to be appointed by the Security Agent) as the Enforcing Senior Creditors Instructing Group shall instruct in the Enforcement Notice orinstruct, in the absence of provided any such instructions, in accordance instructions are consistent with paragraph (c) of Clause 12.3 (Enforcement Instructions) and the Security Enforcement Principles, and in any case always pursuant to the Security Enforcement Objective.

If the Transaction Security is being enforced pursuant to Clause 12.3 12.2 (Enforcement Instructionsinstructions), the Security Agent shall enforce the Transaction Security in such manner (including, without limitation, the selection of any administrator of any Debtor to be appointed by the Security Agent) as the Enforcing Senior Creditors Instructing Group shall instruct in the Enforcement Notice or, in the absence of any such instructions, in accordance with paragraph (c) of Clause 12.3 (Enforcement Instructions) and as the Security Enforcement PrinciplesAgent sees fit, and in any case always pursuant subject to the terms of the relevant Transaction Security Enforcement ObjectiveDocuments.
