Manner of Disclosure. Any information and data disclosed by a Discloser will be considered as Confidential unless indicated otherwise in writing by Discloser. Manner of Disclosure. Any Confidential Information disclosed in tangible form, shall be marked as "Confidential" or with a similar legend by the Discloser prior to disclosure. Any Confidential Information disclosed orally or visually, shall be identified as such prior to disclosure and summarized in writing by the Discloser to Recipient within thirty (30) days of the disclosure. In case of disagreement regarding said summary, the Recipient shall make any objections in writing within thirty (30) days of receipt of the written summary.

The mere listing (or inclusion of a copy) of a document or other item will not be deemed adequate to disclose a qualification to a representation and warranty unless the representation and warranty pertains only to the existence of the document or other item.

Manner of Disclosure. Disclosure of Technical Information, to the extent that such Technical Information is embodied in documents, shall be made by delivery of two (2) copies. Each Party shall furnish written notice to the other Party that said documents have been received. To the extent that such Technical Information is not embodied in documents, such disclosure shall be made in any other reasonable manner deemed by Simtek and AMKOR, or AMKOR's Affiliate, to be reasonably necessary or desirable. Each Party will demonstrate and explain the practical use and operation of its Technical Information in such appropriate detail as to permit performance hereunder assuming reasonably competent technical skills available to the receiving Party.
