MANDATORY COURT APPEARANCES AND JURY SERVICE. The Board will grant leave with pay to those members of the bargaining unit in the case of jury duty. If on jury duty, pay for days of such absences shall be based on the difference between the employee's regular compensation and the remuneration received for serving as a juror, exclusive of mileage paid by the court. The Board will also grant leave with pay to those members of the bargaining unit when subpoenaed or required to make a court appearance (other than for personal criminal prosecution) for Walnut Township Local School related matters provided that the bargaining unit member's court appearance is not in connection with a matter adverse to the position of the Board.

MANDATORY COURT APPEARANCES AND JURY SERVICE. 1. If in the course of performance of professional duties, and as a result of action arising out of the performance of such duties, a unit member is served with a subpoena issued by any court or agency resulting in involuntary absence from school, the unit member’s salary shall be paid. Paid leave shall not be available to bargaining unit members initiating or pursuing action against the Board of Education, its employees or agents. Any monies received from court or agency, less parking and meals, shall be reimbursed to the Board.

  • Leave for Court Appearances (a) The Employer shall grant paid leave to employees, other than employees on leave without pay, who serve as jurors or witnesses in a court action, provided such court action is not occasioned by the employee's private affairs.

  • Jury Duty/Court Appearance a) To qualify for approval from the College to be absent with pay when summoned to serve on a jury, when subpoenaed as a witness in a criminal proceeding or as a witness in a civil action if not a party thereto, or when appearing as a defendant in a criminal or traffic case if acquitted therefrom, a regular or term employee shall produce the summons or subpoena or submit such other evidence showing the necessity for the absence.

  • Dispute Resolution and Jurisdiction Any controversy or claim arising out of or relating to this Agreement, or the breach thereof shall be settled by arbitration in accordance with the rules of the American Arbitration Association and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof, except that arbitration shall not apply to (1) controversies and claims of less than $5,000, nor to (2) claims seeking to collect liquidated amounts, such as the Tuition promised by the student. Any legal dispute (not resolved in arbitration) shall be governed by the laws of the state of California, and that Santa Xxxxxxx courts are the exclusive venue.

  • Mediation and jurisdiction 1. The data importer agrees that if the data subject invokes against it third-party beneficiary rights and/or claims compensation for damages under the Clauses, the data importer will accept the decision of the data subject:

Leave shall also be granted for attendance in court in connection with an employee's official duty, which shall include any necessary travel time. Such employee shall be paid for the employee's regular rate of pay but shall remit to his/her Appointing Authority the amount received, exclusive of expenses, for serving as a witness, as required by the court. Unpaid leave shall be granted for other appearances before a court, judicial or quasi-judicial body in response to a subpoena.

  • Jury Duty and Court Appearances (1) An employee who is summoned as a member of a jury panel or subpoenaed as a witness in a matter not involving the employee's personal interests, shall be granted leave with pay and any jury or witness fees shall be retained by the employee; leave granted hereunder shall not affect an employee's annual or sick leave balance.
