A Mandated Overtime clause establishes the employer's right to require employees to work beyond their standard scheduled hours. Typically, this clause outlines the conditions under which overtime may be assigned, such as during peak business periods or to meet urgent project deadlines, and may specify advance notice requirements or compensation rates for overtime hours. Its core practical function is to ensure the employer can maintain necessary staffing levels and operational continuity during periods of increased demand, while also clarifying expectations and obligations regarding overtime work.
Mandated Overtime overtime that is needed that day or the following shift and nobody has volunteered to work the hours under the short range unplanned overtime process.
Mandated Overtime. No employee shall be mandated more than once in a twenty-four (24) hour period or required to provide more than twenty-four (24) hours of consecutive service (exclusive of sleepovers).
Mandated Overtime. It is understood by Bargaining Unit members that they shall make themselves available for required overtime work on orders from the University to assist during unexpected situations, which do not allow for pre-scheduling. Unscheduled overtime assignments (mandatory overtime) will be offered on a voluntary basis within a work area. If the mandatory overtime is not voluntarily picked up, it will be assigned to bargaining unit members based on inverse seniority in their position. Once a member has worked a mandatory overtime assignment, the member shall not be eligible to work another mandatory overtime assignment until all other bargaining unit members in their work area have also worked a mandatory overtime assignment.
Mandated Overtime. Through Labor/Management, each facility will consider adding to its Overtime Policy that an employee excused from mandated overtime due to a restriction on the number of hours he/she can work in a workday will be expected to work the next mandate that falls on his/her scheduled day off.
Mandated Overtime. Once an overtime assignment has been offered to and declined by all eligible employees within the classification, the Employer may mandate the overtime assignment be worked by the eligible employee within the classification with the least number of hours of overtime worked as of the time the Employer identified the need.
Mandated Overtime. A. Anticipated Overtime
1. The following procedure addresses City's need to mandate overtime work with reference to anticipated overtime needs. Whenever the Police Chief or designee identifies a need for overtime staffing, Police Chief will seek Unit employee volunteers in the following order:
a. Volunteers within the specific work unit
b. Volunteer part-time employees
c. Volunteers from other work units
2. Once the above process has been exhausted and the overtime staffing needs have not been met, overtime work will be mandated for employees within the specific work unit according to an employee's availability, seniority, current overtime commitment and equity.
3. Each division of the unit can formulate an overtime policy that is consistent with this MOU. Those divisions that do not contain sworn officers, but do require the use of officer overtime, will limit the use to not more than 25% of the division's overtime commitment.
Mandated Overtime. If the YSU Police Chief or their designee determines that any extra detail or shift cannot be adequately staffed as a result of the inability to obtain intermittent, part-time, or full- time employees, a bargaining unit member may be required to work the assignment. These assignments will be made on a rotating basis according to least seniority. That is, the bargaining unit member with the least seniority in the classification will be required to work the first such assignment, the next least senior bargaining unit member in the classification the second such assignment, and so on. A mandate roster for each classification with mandated dates will be kept in Dispatch. The University agrees to give as much notice as possible for pre-scheduled shifts and events/details that require a mandate. The procedure for mandating is as follows:
1. When there is any short-term notice for a deficit in either a shift or special detail, a full-time call out and text message will be sent to all full-time members first. Any member who responds will be given the detail or shift. If multiple members reply, the member who is next on the aggregate list will be given the shift or detail. If no full-time member responds in a reasonable amount of time (based on time between the notice and the start time of the shift or detail), a text message will be sent to all intermittent employees. If no intermittent employees reply, the current shift bargaining unit members will be asked in aggregate order to volunteer for the shift or detail. If no one volunteers, the next bargaining unit member on the mandate list present on the current shift will be mandated to work the shift or detail deficit.
2. If the callout process has not been completed by the beginning of the deficit shift or detail, a volunteer from the current shift will be asked in aggregate order to remain until a replacement officer arrives. If no one volunteers, the next bargaining unit member on the mandate list present on the current shift will be mandated to stay until the replacement arrives. If no replacement is found, the mandated bargaining unit member will complete the shift or detail where there is a deficit.
3. If there is a volunteer from either the full-time bargaining unit members or intermittent employees being called, and they will not be able to arrive in time to start the detail or shift, a volunteer from the current shift will be asked in aggregate order to remain until the replacement arrives. Mandated Overtime. Overtime shifts not covered using the above voluntary availability list may require LC911 employees to be mandated overtime. LC911 will solicit qualified employees, part-time employees, and supervisors to reduce mandated overtime. Employees may find other qualified coworkers to cover mandated overtime shifts. Any coverage changes or trades will require advance management approval. When mandated overtime cannot be avoided, assignment will take into consideration qualified employees who are not already on long duration shifts, rest period between the next shifts, and the amount of overtime already assigned to the employee using the above-described list by requiring the employee that is available to work mandated overtime, and who has worked the least number of overtime hours, to work. Seniority shall serve as the determining factor in the event of a tie breaker between two employees’ overtime hours. After the overtime is posted, employees may still volunteer for the open shifts. Overtime assignments can only be changed with the agreement (all such changes will be documented in writing) of the person desiring to work the overtime and the person forced to work the overtime and prior notice to the appropriate supervisor. At the employee’s request mandated overtime may be substituted for compensatory time at the rate of 1 and ½ times the hours worked with advance approval from management.
Mandated Overtime. In the event sufficient personnel do not accept overtime on a voluntary basis, or in the event of an emergency situation where time is of the essence in executing the overtime work, such additional personnel as are deemed necessary by the City may be required to work overtime on an assigned basis.
