Managing Authority. The Managing Authority may delegate tasks to the Joint Technical Secretariat, therefore the Joint Technical Secretariat may act in the name and on behalf of Managing Authority. The Managing Authority / Joint Technical Secretariat has the right to decide on the eligibility of expenditures related to the payment request. The Managing Authority has the obligation to support the Lead Partner by providing necessary information and clarifications for the implementation of the project. The Managing Authority has the obligation to reply to any written solicitation from the LP in maximum 20 working days from the date the MA receives the request. The Managing Authority / Joint Technical Secretariat ensures the technical and financial monitoring of the project. The Managing Authority has the right to accept or not accept expenditures related to the reimbursement claims submitted by the Lead Partner. The Managing Authority has the obligation to inform the Lead Partner regarding conclusions and recommendations made by the European Commission, concerning the project. The Managing Authority is entitled to transfer the advance payment and reimburse the expenditures. The Managing Authority is entitled, in whole or in part, to terminate this contract and to reallocate the grant, if the project implementation does not respect the conditions laid down in the present contract.

Managing Authority. The MA shall make available the information regarding the official closure date of the Ro-Bg Programme to the LB within 5 working days from the date of the receipt of the Commission’s official notification in this respect. The MA has the right to decide on the eligibility of expenditure related to the expenditure claimed in a project report. The MA has the obligation to support the LB by providing necessary information and clarifications for the implementation of the project. The MA has the obligation to reply to any written request from the LB in maximum 30 days from the date the MA receives the request. The MA is entitled to verify and to control the proper use of funds by the LB or by its project partners. The verifications to be carried out by the managing authority shall cover administrative, financial, technical and physical aspects of the project, as appropriate. The MA shall be responsible for the control of the proper use of funds by the LB or by its partners, in particular through preventing, detecting and correcting irregularities and recovering amounts unduly paid together with interest on late payments where appropriate. The responsible auditing bodies of the EU and the two partner states and, within their responsibility, the Audit Authority from Romania and the group of auditors as well as the MA are entitled to audit the proper use of funds by the LB or by its project partners or arrange for such an audit to be carried out by authorized persons. MA is entitled to verify the sustainability of the project for a period of 5 years after the final payment. The MA shall authorize and reimburse all eligible expenditures related to the project reports submitted by the LB, as per the First Level Control (FLC) Reports issued by FLC and recommendation of the JS. The MA has the obligation to inform the LB regarding the reports, conclusions and recommendations made by the European Commission or Audit Authority that may affect the implementation of the present contract. Additional obligatory deadlines to submit a project report may be set by the MA in order to avoid decommitment of ERDF contribution at Programme level. The additional deadlines shall be communicated at least 2 months in advance to the LB. In case one of the obligations of the Lead Beneficiary is not fulfilled, the MA may suspend the execution of the contract. Managing Authority. The Managing Authority (hereinafter referred to as “MA”) is responsible for the overall manage­ment and implementation of the Programme. This involves cooperation with other Pro­gramme bodies such as the monitoring committee (MC) and the Audit Authority as well as with the European Commission and other EU-funded programmes. The participating countries decided on 14.05.2014 to designate Investitionsbank Schleswig-Holstein (XX.XX), Kiel, Germany, to fulfil the functions of the Managing Authority of the programme. The MA shall carry out the functions laid down in Article 125 of Regulation (EU) No 1303/2013. In accordance with Article 23 of Regulation (EU) No 1299/2013, the MA shall set up a Joint Secretariat (hereinafter referred to as “JS”), in particular to assist the MA and the MC in carrying out their respective functions. Based on Article 21(1) of Regulation (EU) No 1299/2013, the MA shall also be responsi­ble for carrying out the functions of the Certifying Authority as defined in Article 126 of Regulation (EU) No 1303/2013 and Article 21(2) of Regulation (EU) No 1299/2013. By signing this Agreement, the XX.XX accepts to fulfil the respective functions in compliance with the above mentioned EU Regulations, the Programme, the decision of the European Commis­sion approving the Programme, this Agreement and the Programme Manual. Without prejudice to these rules, the XX.XX shall carry out its tasks in full accordance with the institutional, legal and financial systems of the Federal Republic of Germany. The countries participating in the Programme will support the XX.XX in its efforts to fulfil its func­tions according to the rules. The MA does not carry out verifications under Article 125(4)(a) of Regulation (EU) No 1303/2013 throughout the whole Programme area. For this reason and based on Article 23(4) of Regulation (EU) No 1299/2013, each participating country designates the bodies or persons responsible for carrying out such verifications in relation to beneficiaries on its territory (hereinafter referred to as “first level controller” or “controller”). Accordingly, the MA shall satisfy itself that the expenditure of each beneficiary participating in an operation has been verified by a controller in compliance with Article 23(4) of Regulation (EU) No 1299/2013.
