MANAGEMENT RIGHTS 4. 01 All the functions, rights, powers and authority which the Employer has not abridged, delegated or modified by this Agreement are recognised by the Union as being retained by the Employer.

MANAGEMENT RIGHTS 4. 01 The Union recognizes the undisputed right of the Company to operate and manage its business in all respects in accordance with its commitments and responsibilities, including those of its customers and to make and alter from time to time, rules, regulations and policies to be observed by the employees, which rules and regulations shall not be inconsistent with the provisions of this Agreement. The Union further recognizes that the Company retains all the customary rights, responsibilities, functions, and prerogatives of management, except as expressly modified or restricted by a clause of this Agreement. The exercise of these rights shall be done in a fair and equitable manner.
MANAGEMENT RIGHTS 4. 01 Subject to the right of either Party to lodge a grievance as set out in this Collective Agreement and subject to the other terms, provisions and conditions contained in this Collective Agreement, the Parties recognize the sole and exclusive right and obligation of the Board to exercise its management rights and functions including the right to manage the affairs of the Board in all respects and to carry out such other responsibilities of the Board which are not specifically abridged or amended or limited by the terms of this Collective Agreement. The Board agrees that none of its rights or functions will be exercised contrary to the provisions of this Collective Agreement.

MANAGEMENT RIGHTS 4. 4.01 Except as expressly provided in this Agreement, the Employer has the authority and responsibility to manage, operate and generally regulate its facility, affairs and functions.
MANAGEMENT RIGHTS 4. 01 The right to manage operations and to direct employees is retained exclusively by the Employer except as this Agreement otherwise specifies.
