The Cooperator acknowledge[s] that all supporting materials and draft documents may become part of the administrative record and may be subject to the requirements of the Freedom of Information Act (FOIA) and other federal statutes. The BLM acknowledges that the Cooperator’s[s’] handling of these materials may be impacted by Colorado Open Meetings Law (24-6-401, C.R.S.). The Parties agree that the BLM at its discretion may withhold from the cooperator[s] those documents that would otherwise be available for public release under Colorado Open Meetings Law (24-6-401, C.R.S.).

The Cooperator agrees not to release these materials to individuals or entities other than the Parties to this MOU and their contractors, unless required to do so by law. The Cooperator shall ensure their contractors adhere to the same level of confidentiality.

The BLM acknowledges that the Cooperator’s handling of these materials may be impacted by the Washington Public Records Act, RCW 42.56. The Parties agree that the BLM, at its discretion, may withhold from the Cooperator those documents that would otherwise be available for public release under the Washington Public Records Act. The Parties also agree that the San Xxxx Island National Historical Park, at its discretion, may withhold from the BLM those documents that would otherwise be available for public release under the Freedom of Information Act and other Federal statutes. Information withheld or otherwise not submitted cannot be considered in the San Xxxx Islands National Monument RMP/EIS process.

The Cooperator acknowledges that all supporting materials and draft documents may become part of the project record and may be subject to the requirements of the Freedom of Information Act (FOIA) and other federal statutes. The BLM acknowledges that the Cooperator’s handling of these materials may be impacted by §00-00-000 to 00-00-000, C.R.S. The Parties agree that the BLM at its discretion may withhold from the cooperators those documents that would otherwise be available for public release under 00-00-000 to 00-00-000, C.R.S.
