Common use of Lottery Clause in Contracts

Lottery. The Charter School shall be open to students of school age deemed residing within the Loudoun County School Division as determined by Section 22.1-3 of the Code of Virginia and shall be through a lottery process on a space-available, grade level basis if applications exceed capacity at each grade level. The lottery and waiting list (described below) shall be the responsibility of the Charter School’s management committee to conduct, administer and successfully complete. In accordance with Section 22.1-212.6 of the Code of Virginia, a waiting list shall be established if space will not available to accommodate all of the students of parents who have requested to be entered into the lottery process. The waiting list shall be prioritized and parents shall be informed of their student’s position on the list. If more students apply than can be admitted, admission decisions will be made by a lottery process held each spring for the following school year.
