LOT GRADING a) The Owner AGREES with the City that all Lots and Blocks will be graded in accordance with the Lot Grading Plan on file with the City and identified as Schedule “E”, and in the manner described in Schedule “C” hereto and topsoil will be replaced in accordance with Section 16 of this Agreement hereof and further that prior to the placing of topsoil on any of the Land herein the Owner will arrange for an inspection of and receive the approval of the lot grading by the Engineer.

LOT GRADING. Purchasers/Tenants are advised that it may be necessary for the Subdivider, in order to comply with the grading requirements of the Town, to enter upon said Lands in order to complete or alter the grading of such lot and that the conveyance to the purchaser reserves a license to the Subdivider to enter upon said Lands in order to complete or alter any of the grades on the said lot as may be required by the Town in order to provide proper drainage to any of the lots on the plan. The purchaser shall also be advised that the proposed lot grading may require the use of retaining walls and/or sloping. Where retaining walls are constructed on the lot being sold, the purchaser shall be advised that such retaining walls will be maintained in good condition and repair for a period of 2 years from completion of the same, after which time the maintenance and repair of such walls shall be the responsibility of the purchaser.
LOT GRADING. PLAN means a drawing showing grades, xxxxxx and drainage patterns and may include catch basins and floor heights in relation to grades for each individual building Lot or Block in the Development Plan.
LOT GRADING. All Lands shown within the Plan shall be graded in general conformity with the Lot Grading Plan, including fill and excavation as required for the full width and length of the grades and levels, and to the specifications, requirements and satisfaction of the Director of Infrastructure and Development. Provided that for residential Lots and Blocks, grading must be brought within zero decimal nine (0.9) metres of the final grade and such further residential development may complete the grading. All work done by the Developer must be of such a nature as to ensure that the integrity and intent of the overall Lot Grading Plan is functional until the Lands are fully developed.
LOT GRADING. “Purchasers are not to alter the grading or change the elevation of their lot. A purchaser’s lot grading should be in accordance with the drainage plans approved by the City of Brampton.”
LOT GRADING. 12. The Subdivider shall establish, maintain or cause to be maintained, whether or not the Subdivider is then the owner of the Land, the elevations and grades on all lots and blocks as shown on the Plan in accordance with the General Grading Plan which has been approved in accordance with the said Subdivision Agreement at all times until the Works have been assumed by a By-law of the County as contemplated by paragraph 56 of said Subdivision Agreement.

The Owner AGREES to place in the deed, transfer or conveyance for every Lot and Block a restrictive covenant in favour of the remaining land affected by this Agreement that the purchaser or transferee will not alter the drainage on the land in any way as to adversely affect the drainage pattern established by the Lot Grading Plan as amended and approved by the City. That restrictive covenant shall run with the land and shall state that the Owner will not do, or cause to be done, any activity that alters the drainage on the land including, but not limited to, constructing a building or structure without the approval of the City’s Engineering and Corporate Assets Department, placing fill, planting trees, or landscaping.
