Common use of Loss of Licence Clause in Contracts

Loss of Licence. (a) A full-time employee with one (1) or more years of service shall not be subject to dismissal for loss of his/her driver’s license for a first occurrence, unless also convicted of causing an accident involving serious bodily harm or major property damage, or drugs for other than medical purposes, but shall be placed on lay-off without pay or benefits until his/her licence is restored. A second such occurrence will subject the employee to dismissal. It is understood that, in case of such a suspension of licence not resulting in dismissal, a Casual Employee may be engaged as a replacement.
