If there is a change of the Loan Servicer, Borrower will be given written notice of the change which will state the name and address of the new Loan Servicer, the address to which payments should be made, and any other information RESPA requires in connection with a notice of transfer of servicing.

Loan Servicer. At the option of Lender, the Loan may be serviced by a servicer selected by Lender and Lender may delegate all or any portion of its responsibilities under this Agreement and the other Loan Documents to such servicer pursuant to a servicing agreement between Lender and such servicer. A sale may result in a change of the Loan servicer. There also may be one or more changes of Loan servicer unrelated to a sale of the Note. If there is a change of Loan servicer, Borrower will be given notice of the change.

Funding Lender may from time to time designate a servicer to collect payments and deposits and receive Notices under the Project Note, the Security Instrument, the Continuing Covenant Agreement and any other Financing Document, and otherwise to service the Project Loan evidenced by the Project Note for the benefit of Funding Lender. All references to Funding Lender in this Assignment will refer to and include any such servicer to the extent applicable.

Loan Servicer. The Borrower acknowledges and agrees that Fannie Mae will designate an independent contractor to act as a Loan Servicer for the Loans. The Borrower agrees that to the extent that any provision in this Agreement or any other Borrower Document requires, on stipulated dates or upon request, the ¨delivery by the Borrower of certain notices, documents, certificates, opinions, and financial or other information to Fannie Mae, all such items shall instead be delivered to, or at the request of, the Loan Servicer, subject to the provisions of this Section 9.12. The Borrower acknowledges and agrees that Fannie Mae has delegated certain functions to the Loan Servicer with respect to the Mortgage Loan Documents and the other Borrower Documents, subject to and in accordance with the provisions of the Servicing Agreement. The Borrower further acknowledges and agrees that in connection with any provision in this Agreement or in the Mortgage Loan Documents requiring that any notices, documents or other information shall be given to the Loan Servicer, or that the Loan Servicer shall have the right to request any documents or other information from any Borrower, Fannie Mae shall have the right to instruct any Borrower to instead (a) deliver such items directly to Fannie Mae or to such other Person as Fannie Mae may, from time to time, designate, and (b) act in accordance with the instructions of Fannie Mae with respect to any such items or any other rights the Loan Servicer may have under this Agreement or under the Mortgage Loan Documents. In addition, the Borrower agrees that any right of Fannie Mae to give or deliver to any Borrower any notice or other communications, or to receive from any Borrower any document or other information, may be given, delivered or received by Loan Servicer, unless otherwise directed by Fannie Mae. The Borrower shall act in accordance with any instructions received from Fannie Mae pursuant to this Section 9.12. Loan Servicer. The parties to this Agreement acknowledge and agree that, except as otherwise provided below, in connection with any provision of this Agreement under which Xxxxxx Xxx is granted the right to (a) request that the Borrower, Master Tenant, Operator or another party (i) take or refrain from taking certain action, or (ii) collect or deliver certain payments, information, documents or instruments, (b) give any instructions or directions or perform any work or inspections, or (c) exercise remedies under this Agreement, Loan Servicer is hereby authorized to act on behalf of, and in the place and stead of, Xxxxxx Xxx. Any rights of Loan Servicer to act on behalf of Xxxxxx Mae pursuant to the preceding sentence shall be terminated as and to the extent determined by Xxxxxx Xxx upon delivery by Xxxxxx Mae to the parties to this Agreement of notice of such termination. Loan Servicer is neither affiliated with, nor acting as an agent for, the Borrower, Master Tenant, Operator or Xxxxxx Xxx.
