LOA Due to Medical Reasons, Including L/I. When an employee is anticipated to be on 39 extended leave for medical reasons of the employee or family member, paid or unpaid, L/I, 40 current secretaries at the location who have fewer hours or are at a lower tier than the vacated 41 position will be offered the opportunity to temporarily fill the position by seniority, assuming the 42 qualification requirements of the position are met. The fill-in employee will receive wages at the 43 Tier of the position and at their current step. If the employee accepts the temporary position, their 44 position will be filled with a substitute. The employee filling in will return to their previous 45 position upon the return of the employee. If no secretary at the location accepts the temporary 46 position, it will be filled with a substitute. If it is known through medical documentation or the 47 employee’s self-report that the leave will exceed twelve (12) work months on Workers 48 Compensation or extended medical leave of the employee, inclusive of FMLA and/or paid leave, 1 their position will be posted as a continuing position. If the District has received medical 2 notification that the employee will no longer be able to perform the essential functions of the 3 position, and after discussion with the employee, the district has determined that no reasonable 4 accommodation can be made, the position will be posted as a continuing position. If such leave is 5 granted due to extended illness, one (1) additional year may be granted, allowing the employee to 6 retain their seniority date during this period for up to two (2) years from the initial date of leave.

If an 23 employee’s leave exceeds twelve (12) calendar months or an employee self-reports or provides 24 medical documentation that the leave will exceed twelve (12) months on L/I or other extended 25 medical reasons, inclusive of FMLA and/or paid sick leave of the employee, their position will 26 be posted as a continuing position. Employees shall retain their seniority date during this period 27 for up to two (2) years from the initial date of leave. 29 If the District has received medical notification that the employee will no longer be able to 30 perform the essential functions of the position, and after discussion with the employee, the 31 District has determined that no reasonable accommodation can be made, the position will be 32 posted as a continuing position.
