Limitations to Services Provided. Client understands and acknowledges that: ● No employee, representative or agent of Xxxxx will physically examine, inspect or even see the Aircraft during the course of the prebuy examination, and that Savvy will and must rely entirely on the prebuy examination conducted by the Service Center and the written list of discrepancies prepared by the Service Center; ● Xxxxx’s review and advice will only be as good as the written results of the examination provided to Savvy by the Service Center; ● The prebuy examination performed by the Service Center is not an “inspection” of the airplane as that word is defined in the U.S. Federal Aviation Regulations or other applicable regulations; and ● In respect to the SavvyPrebuy service, in the absence of termination, the Agreement expires, and Savvy shall be deemed to have completed its obligations hereunder, upon notifying Client that Savvy has completed its performance of the Services.

Limitations to Services Provided. Client understands and acknowledges that: • Savvy will not make maintenance decisions concerning Aircraft; such decisions are the sole responsibility of Client. Savvy will offer consultation and advice to assist Client’s decision-making process, but the ultimate decisions about what maintenance is to be performed on Aircraft, how, where and when it is to be performed, and whether Aircraft is airworthy and safe for flight is strictly the responsibility of Client. • Xxxxx’s advice will be based solely on information about Aircraft and its condition provided by Client. Savvy will not physically examine Aircraft or communicate with maintenance providers. Consequently, Xxxxx’s knowledge of Aircraft’s condition might be inaccurate or incomplete. • Service requests by Client will be handled serially (i.e., one at a time) by Xxxxx. • Savvy will communicate about Aircraft only with Client. Savvy will not communicate with maintenance providers, flight instructors, or other third- parties.

  • Access to Services 1. Subject to DHCS provider enrollment certification requirements, the Contractor shall maintain continuous availability and accessibility of covered services and facilities, service sites, and personnel to provide the covered services through use of DMC certified providers. Such services shall not be limited due to budgetary constraints.

  • Modifications to Service This Auction Site reserves the right to modify or discontinue the Service with or without notice to user. This Auction Site shall not be liable to users or any third party should this Auction Site exercise its right to modify or discontinue the Service.

  • Changes to Services The Parties acknowledge and agree that there will be changes to the scope of the Services during the Contract Period. The Customer may amend the Stories that are comprised within the Minimum Marketable Features of a Release at any time during the Release at no additional charge and without adopting the Change Control Procedure set out in Clause 28 above provided that: the Customer shall not be entitled to make any changes to the Stories that form the subject of a Sprint following the mutual agreement by the Parties of the Sprint Plan for that Sprint; new Stories and/or changes to existing Stories may only be introduced if: existing Stories with an equivalent number of Story Points are removed; or existing Stories are reduced in size by the equivalent number of Story Points, such that the total number of Story Points for the Release remains constant throughout the Release. The Supplier shall consider any request by the Customer to increase the number of Story Points for a Release, and may, subject to the Change Control Procedure set out at Clause 28, agree to such request.

  • Access to Service You acknowledge that Your ability to access the Service may require the payment of third- party fees (such as telephone toll charges, ISP, or airtime charges) and that You are responsible for paying such fees. The Provider is not responsible for any equipment You may need to be able to access the Service.

  • Limitations of Services When using the Services, you may incur technical or other difficulties. We nor our service providers are responsible for any technical or other difficulties or any resulting damages that you may incur. Any information displayed or provided as part of the Services is for informational purposes only, may not reflect your most recent transactions, and should not be relied on for transactional purposes.   • Limitation on Services Except in cases of Emergency Services or Urgent Care, or as otherwise provided under this Certificate, services are available only from Participating Providers and HMO shall have no liability or obligation whatsoever on account of any service or benefit sought or received by a Member from any Physician, Hospital, Skilled Nursing Facility, home health care agency, or other person, entity, institution or organization unless prior arrangements are made by HMO.

  • Limitations of Use The Services and Atlantic Broadband Equipment, including any firmware or software embedded in Atlantic Broadband Equipment or used to provide the Services, are protected by trademark, copyright, and/or other intellectual property laws and international treaty provisions. You are granted a limited, non-sublicensable, non- transferable revocable license to use such firmware and software in object code form (without making any modification thereto) strictly in accordance with this Agreement. You acknowledge and understand that you are not granted any other license to use the firmware or software embedded in Atlantic Broadband Equipment or used to provide the Services. You expressly agree that you will use Atlantic Broadband Equipment exclusively in connection with the Services. You shall not reverse, compile, disassemble, or reverse engineer or otherwise attempt to derive the source code from the binary code of the firmware or software. If you decide to use the Services through an interface device not provided by Atlantic Broadband, which Atlantic Broadband reserves the right to prohibit in particular cases or generally, you warrant and represent that you possess all required rights to use that interface device with the Services, including all software and firmware licenses. You will indemnify and hold harmless Atlantic Broadband against any and all liability arising out of your use of such interface device with the Services.

  • LIMITATIONS OF COVERED MEDICAL SERVICES In order to be covered, the Member’s Attending Physician must specifically prescribe such services and such services must be consequent to treatment of the cleft lip or cleft palate.

  • Allocation and use of scarce resources Any procedures for the allocation and use of scarce resources, including frequencies, numbers and rights of way, will be carried out in an objective, timely, transparent and non-discriminatory manner. The current state of allocated frequency bands will be made publicly available, but detailed identification of frequencies allocated for specific government uses is not required.

  • AMENDMENTS TO SERVICE AGREEMENT With effect from the date of this Deed the Parties agree that the Service Agreement is varied so that:
