LIMITATION ON COSTS. Reimbursement by the Department shall be 55% of the total cost or not to exceed Fifteen Thousand Dollars ($15,000.00). The Grantee shall provide 45% of the total cost, or Twelve Thousand Five Hundred Dollars ($12,500.00). See itemized budget in Attachment A.

LIMITATION ON COSTS. Contractor is not liable for any cost in excess of the amount listed above as “Total Amount Obligated” without prior formal modification to this Subcontract. Attachment 2, “Subcontractor Statement of Work, Budget, and Reporting Requirements,” is hereby made part of this Subcontract. 3. Payment: Subcontractor shall invoice Contractor not more often than monthly and not less frequently than quarterly for allowable costs incurred. All invoices shall be submitted using Subcontractor's standard invoice, but at a minimum shall include current and cumulative costs, Subcontract number, and certification as to truth and accuracy of invoice. Invoices that do not reference Subcontract Number may be returned to Subcontractor. Invoices and questions concerning invoice receipt or payments should be directed to the appropriate party's Financial Contact as shown in Attachments 3A & 3B. All payments shall be considered provisional and subject to adjustment if adjustment is necessary as a result of an adverse audit finding against Subcontractor. Contractor reserves the right to reject any invoice that does not comply with the terms of this Subcontract. Subcontractor shall have the right to submit a correct invoice. A corrected invoice should be submitted as soon as possible, and no later than thirty (30) days following the end of the Period of Performance. 4.
LIMITATION ON COSTS. For purposes of Sections 1.3 and 1.4 above, any increases in salary rates incurred by OXIS from one billing period to the next will be limited to the actual increase in such costs experienced by OXIS, provided OPUS was given notice of such increases.
LIMITATION ON COSTS. The Department's contribution to the total cost, both direct and indirect, of performing the tasks under this Agreement shall not exceed the total amount for eligible costs, as identified in the Attachments. Changes to this Agreement that do not affect the total amount for eligible costs may be made by written agreement of both the Department and the Grantee.
LIMITATION ON COSTS. Contractor shall not be entitled to any compensation for Work subject to a Change Order except as expressly set forth in this Article.
