Common use of Limitation of Landlord’s Liability Clause in Contracts

Limitation of Landlord’s Liability. If Landlord shall fail to perform any term, condition, covenant or obligation required to be performed by it under this Lease and if Tenant shall, as a consequence thereof, recover a money judgment against Landlord, Tenant agrees that it shall look solely to Landlord’s right, title and interest in and to the Building for the collection of such judgment; and Tenant further agrees that no other assets of Landlord shall be subject to levy, execution or other process for the satisfaction of Tenant’s judgment.

If Landlord shall fail to perform or observe any term, condition, covenant or obligation required to be performed or observed by it under this Lease and if Tenant shall, as a consequence thereof, recover a money or judgment against Landlord, Tenant agrees that it shall look solely to Landlord’s right's equity in the Demised Premises for any recovery, title and interest in and to the Building for the collection of such judgment; and Tenant further agrees that no other assets of Landlord shall not be subject to levy, execution or other process liable for the any deficiency and satisfaction of Tenant’s 's judgment.
